1.4    Subdivision 1. Executive Order 20-01 peacetime emergency terminated. Effective
1.5July 1, 2021, at 11:59 p.m., and consistent with Minnesota Statutes, section 12.31, subdivision
1.62, paragraph (b), the peacetime emergency declared by Executive Order 20-01 issued March
1.713, 2020, is terminated.
1.8    Subd. 2. Acknowledgement of authority. (a) Notwithstanding whether a peacetime
1.9emergency declared under Minnesota Statutes, chapter 12, is in effect, the governor may
1.10exercise authority under that chapter as necessary to coordinate, allocate, distribute, and
1.11manage COVID-19 vaccination and testing activities.
1.12(b) Nothing in this section limits the authority of the governor to:
1.13(1) exercise emergency powers granted in Minnesota Statutes, chapter 12, between the
1.14effective date of this section and July 1, 2021, at 11:59 p.m.; or
1.15(2) consistent with Minnesota Statutes, chapter 12, declare a new peacetime emergency,
1.16including an emergency related to the COVID-19 infectious disease outbreak, at any time.
1.17(c) Notwithstanding any other law to the contrary, the commissioner of human services
1.18or the commissioner of health may declare a public health disaster if either commissioner
1.19determines that the state must take action to protect the public health, including providing
1.20public health services or enforcing existing health and human services laws, as part of the
1.21state's response to the ongoing COVID-19 infectious disease outbreak.
1.22    Subd. 3. Orderly transition of government COVID-19 response. Notwithstanding
1.23whether a peacetime emergency declared under Minnesota Statutes, chapter 12, is in effect,
2.1any other law to the contrary, or any contrary expiration date specified within the following
2.2executive orders, Executive Order 20-05 issued on March 16, 2020, Executive Order 20-07
2.3issued on March 17, 2020, Executive Order 20-21 issued on March 27, 2020, and Executive
2.4Order 20-29 issued on April 6, 2020, remain in full force and effect until August 1, 2021,
2.5at 11:59 p.m.
2.6EFFECTIVE DATE.This section is effective the day following final enactment."
