1.4FOR MINORS AND VULNERABLE ADULTS.
1.5    Subdivision 1. Definitions. (a) For purposes of this section, the following terms have
1.6the meanings given them.
1.7(b) "Gender transition medical services" means a medical or surgical service that assists
1.8an individual in transitioning physically to a sex different from the individual's birth sex,
1.9including but not limited to medical services that provide: gonadotropin releasing hormone
1.10analogues, or analogous drugs, or other interventions to delay or suppress pubertal
1.11development in children; cross-sex hormones, or other mechanisms, to promote the
1.12development of feminizing or masculinizing features in the opposite sex; or genital or
1.13nongenital sex reassignment surgery performed for the purpose of assisting an individual
1.14with a sex transition.
1.15(c) "Health care provider" has the meaning given in section 62A.63, subdivision 2.
1.16    Subd. 2. Prohibition. No health care provider licensed by a health-related licensing
1.17board or otherwise licensed under the laws of this state or registered with the commissioner
1.18of health may provide gender transition medical services to a patient younger than 18 years
1.19of age or a vulnerable adult as defined in section 626.5572, subdivision 21. Gender transition
1.20medical services provided to a patient younger than 18 years of age or to a vulnerable adult
1.21shall be considered unprofessional conduct and the health care provider shall be subject to
1.22disciplinary action by the applicable health-related licensing board.
2.1    Subd. 3. Exceptions. This section does not apply to the good faith medical decision of
2.2a parent or guardian of a minor under 18 years of age born with a medically verifiable
2.3genetic disorder of sex development, including:
2.4(1) external biological sex characteristics that are irresolvably ambiguous, such as a
2.5minor born having 46 XX chromosomes with virilization, 46 XY chromosomes with
2.6undervirilization, or having both ovarian and testicular tissue; or
2.7(2) a disorder of sexual development diagnosed by a physician through genetic testing
2.8showing that the minor does not have the normal sex chromosome structure for a male or
2.9female.
2.10EFFECTIVE DATE.This section is effective the day following final enactment, except
2.11that this section shall not prohibit the continuation and completion of gender transition
2.12medical services that were first provided before the effective date of this section."

2.14    "Sec. .... Minnesota Statutes 2022, section 256B.0625, is amended by adding a subdivision
2.15to read:
2.16    Subd. 5o. Gender transition medical services. (a) Medical assistance does not cover
2.17gender transition medical services provided to a person younger than 18 years of age or a
2.18vulnerable adult as defined in section 626.5572, subdivision 21.
2.19(b) For purposes of this subdivision, "gender transition medical services" means medical
2.20or surgical services that assist an individual in transitioning physically to a sex different
2.21from the individual's birth sex, including but not limited to medical services that provide:
2.22gonadotropin releasing hormone analogues, or analogous drugs, or other interventions to
2.23delay or suppress pubertal development in children; cross-sex hormones, or other mechanisms
2.24to promote the development of feminizing or masculinizing features in the opposite sex; or
2.25genital or nongenital sex reassignment surgery performed for the purpose of assisting an
2.26individual with a sex transition."
2.27Renumber the sections in sequence and correct the internal references
2.28Amend the title accordingly
