1.3    "Sec. .... [245J.01] OFFICE OF INSPECTOR GENERAL.
1.4The Office of Inspector General is created as a standalone office outside of the
1.5Department of Human Services. The governor shall appoint the executive director of the
1.6Office of Inspector General under section 15.06. The executive director shall develop and
1.7maintain licensing, background studies, and fraud prevention services in a manner consistent
1.8with sections 256.98 to 256.9861; 256B.0705, subdivision 4; 256B.0949, subdivision 16;
1.9256B.85, subdivision 16; and chapters 245A, 245C, 245D, 245E, and 245H. Office of
1.10Inspector General services shall be provided in coordination with counties and other vendors.
1.11Office of Inspector General services shall include licensing, background studies, fraud
1.12prevention and investigations, and other services consistent with the mission of the Office
1.13of Inspector General. The administrative structure of the Office of Inspector General must
1.14be statewide in character.
1.15EFFECTIVE DATE.This section is effective January 1, 2021.

1.16    Sec. .... [245J.05] TRANSFER OF DUTIES.
1.17(a) Section 15.039 applies to the transfer of duties required by this chapter.
1.18(b) The commissioner of administration, with the approval of the governor, may issue
1.19reorganization orders under section 16B.37 as necessary to carry out the transfer of duties
1.20required by this chapter. The provision of section 16B.37, subdivision 1, stating that transfers
1.21under section 16B.37 may be made only to an agency that has been in existence for at least
1.22one year does not apply to transfers to an agency created by this chapter.
2.1(c) The initial salary for the executive director of the Office of Inspector General is the
2.2same as the salary for the commissioner of health. The salary may be changed in the manner
2.3specified in section 15A.0815.
2.4(d) The commissioner of management and budget must ensure that the aggregate cost
2.5for the executive director of the Office of Inspector General is not more than the aggregate
2.6cost of the primary executives in the Department of Human Services responsible for
2.7management of licensing, background studies, and fraud prevention and investigations
2.8immediately before the effective date of this section.
2.9EFFECTIVE DATE.This section is effective January 1, 2021."

2.11    "Sec. .... RECIPIENT AND CHILD CARE PROVIDER INVESTIGATIONS UNIT
2.12TRANSFER.
2.13Responsibilities of the recipient and child care provider investigations unit of the
2.14Department of Human Services are transferred to the Bureau of Criminal Apprehension,
2.15Department of Public Safety, effective January 1, 2020, provided that the office must be
2.16allowed to maintain its existing space until January 1, 2026. Minnesota Statutes, section
2.1715.039, governs the transfer of responsibilities under this section. No later than January 1,
2.182020, the commissioner of human services and the commissioner of public safety must
2.19submit a transition plan to the chairs and ranking minority members of the legislative
2.20committees with jurisdiction over child care assistance programs and human services program
2.21integrity. The plan must include any additional recommended legislation to implement an
2.22orderly transfer of responsibilities under this section.

2.23    Sec. .... REVISOR INSTRUCTION; CONFORMING STATUTORY CHANGES.
2.24The revisor of statutes, in consultation with House Research Department and Senate
2.25Counsel, Research and Fiscal Analysis, and the commissioner of human services, shall
2.26prepare a bill for introduction in the 2020 legislative session proposing the statutory changes
2.27needed to implement the transfers of duties required by this chapter.
2.28EFFECTIVE DATE.This section is effective July 1, 2019."
