1.3    "Sec. 10. Minnesota Statutes 2024, section 148.56, subdivision 1, is amended to read:
1.4    Subdivision 1. Optometry defined. (a) Any person shall be deemed to be practicing
1.5optometry within the meaning of sections 148.52 to 148.62 who shall in any way:
1.6(1) advertise as an optometrist;
1.7(2) employ any means, including the use of autorefractors or other automated testing
1.8devices, for the measurement of the powers of vision or the adaptation of lenses or prisms
1.9for the aid thereof;
1.10(3) possess testing appliances for the purpose of the measurement of the powers of vision;
1.11(4) diagnose any disease, optical deficiency or deformity, or visual or muscular anomaly
1.12of the visual system consisting of the human eye and its accessory or subordinate anatomical
1.13parts;
1.14(5) prescribe lenses, including plano or cosmetic contact lenses, or prisms for the
1.15correction or the relief of same;
1.16(6) employ or prescribe ocular exercises, orthoptics, or habilitative and rehabilitative
1.17therapeutic vision care; or
1.18(7) prescribe or administer legend drugs to aid in the diagnosis, cure, mitigation,
1.19prevention, treatment, or management of disease, deficiency, deformity, or abnormality of
1.20the human eye and adnexa included in the curricula of accredited schools or colleges of
1.21optometry, and as limited by Minnesota statute and adopted rules by the Board of Optometry,
1.22or who holds oneself out as being able to do so.
1.23(b) In the course of treatment, nothing in this section shall allow:
2.1(1) legend drugs to be administered intravenously, intramuscularly, or by injection,
2.2except for treatment of anaphylaxis; by intraocular or sub-Tenon injection; by injection
2.3posterior to the orbital septum; or by intramuscular injection, except as permitted under
2.4paragraph (d);
2.5(2) invasive surgery including, but not limited to, surgery using lasers;
2.6(3) Schedule II and III oral legend drugs and oral steroids to be administered or
2.7prescribed; or
2.8(4) oral antivirals to be prescribed or administered for more than ten days; or steroids
2.9to be administered or prescribed for more than 14 days without consultation with a physician.
2.10(5) oral carbonic anhydrase inhibitors to be prescribed or administered for more than
2.11seven days.
2.12(c) Nothing in this section shall allow anesthetics to be administered by injection, except
2.13that an optometrist may administer local anesthesia by injection:
2.14(1) for excision of chalazia, except that recurrent chalazia must be referred to a physician;
2.15and
2.16(2) for excision of a single epidermal lesion that: (i) is without characteristics of
2.17malignancy; (ii) is no larger than five millimeters in size; (iii) is no deeper than the dermal
2.18layer of the skin; and (iv) is not a lesion involving the eyelid margin.
2.19(d) An optometrist may inject Botulinum toxin, limited to the periocular muscles of
2.20facial expression innervated by the first two branches of the facial nerve, including for
2.21cosmetic purposes.

2.22    Sec. 11. Minnesota Statutes 2024, section 148.56, is amended by adding a subdivision to
2.23read:
2.24    Subd. 1a. Injections. In order to perform injections permitted under subdivision 1, an
2.25optometrist must receive approval from the board after demonstrating to the board that the
2.26optometrist has sufficient educational or clinical training to perform injections. This
2.27subdivision does not apply to injections for treatment of anaphylaxis."
