1.3Page 1, after line 19, insert:
1.4"(f) No vasectomy shall be performed in this state except with the voluntary and informed
1.5consent of the male upon whom the vasectomy is to be performed. The information required
1.6by this paragraph may be provided without conducting a physical examination or tests of
1.7the male, in which case the information required to be provided may be based on facts
1.8supplied to the physician by the male and whatever other relevant information is reasonably
1.9available to the physician. If a physical examination, tests, or the availability of other
1.10information to the physician subsequently indicates, in the medical judgment of the physician,
1.11a revision of the information previously supplied to the male, that revised information may
1.12be communicated to the male at any time prior to the performance of the vasectomy. Nothing
1.13in this paragraph shall be construed to preclude provision of required information in a
1.14language understood by the male through a translator. Except in the case of medical
1.15emergency, consent to a vasectomy is voluntary and informed only if:
1.16(1) the male is told the following, by telephone or in person, by a physician who is to
1.17perform the vasectomy or by a referring physician, at least 24 hours before the vasectomy:
1.18(i) the particular medical risks associated with the particular vasectomy procedure to be
1.19employed including, when medically accurate, the risks of infection, hemorrhage, and
1.20cancer;
1.21(ii) the medical risks and other risks associated with not obtaining a vasectomy; and
1.22(iii) that medical assistance benefits may be available for prenatal care, childbirth, and
1.23neonatal care if the male does not obtain a vasectomy and a pregnancy occurs;
1.24(2) the male certifies in writing, prior to the vasectomy, that the information described
1.25in clause (1) has been furnished to him; and
2.1(3) prior to the performance of the vasectomy, the physician who is to perform the
2.2vasectomy or the physician's agent obtains a copy of the written certification prescribed by
2.3clause (2) and retains it on file with the male's medical record for at least three years
2.4following the date of receipt."
