1.3    "Sec. .... PEACETIME EMERGENCY; NEW DRIVER'S LICENSES.
1.4    Subdivision 1. Definition. (a) For purposes of this section, the following terms have the
1.5meanings given.
1.6(b) "Commissioner" means the commissioner of public safety.
1.7(c) "Peacetime public health emergency period" means the duration of any peacetime
1.8emergency declared by the governor in an executive order that relates to the infectious
1.9disease known as COVID-19, but ending no later than January 31, 2021.
1.10    Subd. 2. New driver's license issuance. During the peacetime public health emergency
1.11period, the commissioner may issue an initial noncompliant license, as defined in Minnesota
1.12Statutes, section 171.01, subdivision 41a, to an applicant who holds an instruction permit
1.13and who qualifies, except that:
1.14(1) notwithstanding Minnesota Statutes, section 171.071, or Minnesota Rules, part
1.157410.1810, the applicant is not required to appear in-person for a photograph if the
1.16commissioner has a photograph of the applicant on record, provided that the commissioner
1.17must use the most recently available photograph for the applicant's driver's license;
1.18(2) notwithstanding Minnesota Statutes, section 171.13, subdivision 1, paragraph (a),
1.19clause (1), or Minnesota Rules, part 7410.2400, subpart 1, an examination of the applicant's
1.20eyesight is not required if the commissioner has a record that the applicant has passed an
1.21examination of the applicant's eyesight; and
2.1(3) notwithstanding Minnesota Statutes, section 171.13, subdivision 1, paragraph (a),
2.2clause (4), or Minnesota Rules, chapter 7410, the applicant is not required to undergo a
2.3behind-the-wheel road examination at the time of application.
2.4    Subd. 3. Driver's license renewals. For the first renewal of a license issued under this
2.5section, the license holder must pass a behind-the-wheel road examination under Minnesota
2.6Statutes, section 171.13, subdivision 1, paragraph (a), clause (4).
2.7    Subd. 4. Status update. Within two weeks of the effective date of this subdivision, the
2.8commissioner of public safety must submit a status update on implementation of driver's
2.9license issuance under this section to the chairs, ranking minority members, and staff of the
2.10legislative committees with jurisdiction over transportation policy and finance. At a
2.11minimum, the status update must identify an anticipated date for full implementation and
2.12summarize the procedures for driver's license applications under this section.
2.13EFFECTIVE DATE.Subdivisions 1 to 3 are effective July 1, 2020, or the date the
2.14changes required by this section are implemented, whichever is earlier. Subdivision 4 is
2.15effective the day following final enactment. If the changes required by this section are
2.16implemented earlier than July 1, 2020, the commissioner of public safety must notify the
2.17revisor of statutes of the date."
