1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. [325F.676] TICKET SALES.
1.4    Subdivision 1. Definitions. (a) For the purposes of this section, the following terms have
1.5the meanings given.
1.6(b) "Commissioner" means the commissioner of commerce.
1.7(c) "Entertainment" means all forms of entertainment, including but not limited to
1.8theatrical or operatic performances, concerts, motion pictures, entertainment at fairgrounds,
1.9amusement parks, athletic competitions and other sports, and all other forms of diversion,
1.10recreation, or show.
1.11(d) "Internet domain name" means a globally unique, hierarchical reference to an Internet
1.12host or service, which is assigned through a centralized Internet naming authority and which
1.13is composed of a series of character strings separated by periods with the rightmost string
1.14specifying the top of the hierarchy.
1.15(e) "Online ticket marketplace" means the administrator of a website or other electronic
1.16service, including an agent, employee, or assignee of the administrator, that sells tickets or
1.17maintains a platform to facilitate the sale of tickets.
1.18(f) "Operator" means a person, including an agent, employee, or assignee of the person,
1.19who:
1.20(1) owns, operates, or controls a place of entertainment;
1.21(2) produces entertainment; or
1.22(3) sells a ticket to a place of entertainment for original sale.
2.1(g) "Person" means a party, individual, partnership, association, corporation, or other
2.2legal entity.
2.3(h) "Place of entertainment" means an entertainment facility, including but not limited
2.4to an amphitheater, theater, stadium, arena, racetrack, museum, amusement park, venue,
2.5club, or other place where performances, concerts, exhibits, athletic games, contests, or
2.6other forms of entertainment are held. For the purposes of this section, place of entertainment
2.7does not include movie theaters.
2.8(i) "Ticket reseller" means a person that offers or sells tickets for resale after the original
2.9sale to an entertainment event located in this state and includes an operator to the extent
2.10that the operator offers or sells tickets for resale. Sales by a ticket reseller include sales by
2.11any means, including but not limited to in person or by telephone, mail, delivery service,
2.12facsimile, Internet, email, or other electronic means. A ticket reseller does not include a
2.13person that purchases a ticket solely for the person's own use or the use of the person's
2.14invitees, employees, or agents.
2.15(j) "URL" means a uniform resource locator for a website on the Internet.
2.16    Subd. 2. Disclosures. (a) An operator, ticket reseller, or online ticket marketplace must,
2.17at all times during the ticket listing and purchasing process, disclose in an easily readable
2.18and conspicuous manner and in dollars:
2.19(1) the total cost of the ticket, inclusive of all fees and surcharges that must be paid in
2.20order to purchase the ticket;
2.21(2) the portion of the ticket price that represents a service charge; and
2.22(3) any other fee or surcharge charged to the purchaser.
2.23(b) The disclosure of subtotals, fees, charges, and all other components of the total price
2.24must not be false or misleading, and must not be presented more prominently or in the same
2.25or larger size than the total price. The disclosure of subtotals, fees, charges, and all other
2.26components of the total price may be displayed in a manner that allows the purchaser to
2.27hide or minimize the itemized list. The price of a ticket must not increase with respect to a
2.28particular person after the ticket is first displayed to the person, excluding reasonable fees
2.29for the delivery of nonelectronic tickets based on the delivery method selected by the
2.30purchaser and any additional purchases made by the purchaser, which must be disclosed
2.31prior to accepting payment.
3.1(c) A ticket reseller and online ticket marketplace must disclose in an easily readable
3.2and conspicuous manner on the ticker reseller's or online ticket marketplace's website or
3.3electronic service:
3.4(1) that the website or electronic service is owned or operated by a ticket reseller or
3.5online ticket marketplace and that the price of a resale ticket offered for sale may be higher
3.6or lower than the original purchase price;
3.7(2) that the purchaser is responsible for checking with the place of entertainment for
3.8information on changes to the event or cancellations prior to the event's start time; and
3.9(3) the refund policy of the ticket reseller or online ticket marketplace.
3.10A ticket reseller or online ticket marketplace must require a purchaser to confirm having
3.11read the disclosures required by this paragraph before completing a transaction.
3.12(d) A ticket reseller or online ticket marketplace must provide to the purchaser proof of
3.13purchase, which must include all event and ticket information, within 24 hours of the
3.14purchase, including:
3.15(1) that the purchaser is responsible for checking with the place of entertainment for
3.16information on changes to the event or cancellations prior to the event's start time; and
3.17(2) the refund policy of the ticket reseller or online ticket marketplace.
3.18(e) An online ticket marketplace must not use any combination of text, images, trademark,
3.19copyright, web designs, or Internet addresses that is identical or substantially similar to text,
3.20images, trademark, copyright, web designs, or Internet addresses associated with a place of
3.21entertainment without the written permission of the place of entertainment duly authorized
3.22to provide the permission. This paragraph does not prohibit an online ticket marketplace
3.23from using text containing the name of a place of entertainment or of an event in order to
3.24describe the location of the event or the event itself. This paragraph does not prohibit an
3.25online ticket marketplace from providing information or images identifying the specific
3.26seat or area the purchaser will occupy in the place of entertainment.
3.27(f) The obligations of paragraphs (a) to (d) do not apply to any person, unless the person
3.28engaged in annual aggregate transactions that were equal to or greater than $5,000.
3.29    Subd. 3. Prohibitions. (a) A ticket reseller or online ticket marketplace must not:
3.30(1) sell or offer to sell more than one copy of the same ticket to a place of entertainment;
4.1(2) directly or indirectly employ another person to wait in line to purchase tickets for
4.2the purpose of reselling the tickets if the practice is prohibited or if the place of entertainment
4.3has posted a policy prohibiting the practice;
4.4(3) sell or offer to sell a ticket without first informing the person of the location of the
4.5place of entertainment and the ticket's assigned seat, including but not limited to the seat
4.6number, row, and section number of the seat;
4.7(4) sell or offer to sell a ticket for which there is no assigned seat without first informing
4.8the person of the general admission area to which the ticket corresponds; or
4.9(5) advertise, offer for sale, or contract for the sale of a ticket before the ticket has been
4.10made available to the public, including via presale, without first obtaining permission from
4.11the place of entertainment and having actual or constructive possession of the ticket, unless
4.12the ticket reseller owns the ticket pursuant to a season ticket package purchased by the ticket
4.13reseller.
4.14(b) A person must not use or cause to be used an Internet domain name or subdomain
4.15thereof in an operator, ticket reseller, or online ticket marketplace website's URL that contains
4.16any of the following, unless acting on behalf of the place of entertainment, event, or person
4.17scheduled to perform or appear at the event:
4.18(1) the name of a place of entertainment;
4.19(2) the name of an event, including the name of a person scheduled to perform or appear
4.20at the event; or
4.21(3) a name substantially similar to those described in clause (1) or (2).
4.22(c) A person must not:
4.23(1) circumvent any portion of the process for purchasing a ticket on the Internet or for
4.24admission to a place of entertainment, including but not limited to security or identity
4.25validation measures or an access control system; or
4.26(2) disguise the identity of a purchaser for the purpose of purchasing a number of tickets
4.27for admission to a place of entertainment that exceeds the maximum number of tickets
4.28allowed for purchase by a person.
4.29(d) A person must not sell a ticket obtained in violation of paragraph (c) if the person:
4.30(1) participated in or had the ability to control the conduct committed in violation of
4.31paragraph (c); or
4.32(2) knew that the ticket was acquired in violation of paragraph (c).
5.1(e) An operator, online ticket marketplace, or ticket reseller must not sell a ticket unless:
5.2(1) the ticket is in the possession or constructive possession of the operator, online ticket
5.3marketplace, or ticket reseller; or
5.4(2) the operator, online ticket marketplace, or ticket reseller has a written contract with
5.5the place of entertainment to obtain the ticket.
5.6(f) Pursuant to United States Code, title 15, section 45c, circumvention of a security
5.7measure, access control system, or other technological control measure used by an online
5.8ticket marketplace to enforce posted event ticket purchasing limits or to maintain the integrity
5.9of posted online ticket purchasing order rules is prohibited.
5.10    Subd. 4. Commissioner data requests; data practices. Upon request by the
5.11commissioner, an online ticket marketplace must disclose to the commissioner information
5.12about technology and methods used in an alleged violation of subdivision 3, paragraph (f).
5.13Data collected or maintained by the commissioner under this subdivision are civil
5.14investigative data under section 13.39 and the commissioner may share with the attorney
5.15general any not public data, as defined in section 13.02, subdivision 8a, received under this
5.16subdivision.
5.17    Subd. 5. Enforcement. The commissioner may enforce this section under section 45.027.
5.18EFFECTIVE DATE.This section is effective January 1, 2025, and applies to tickets
5.19sold on or after that date."
