1.3    "Sec. .... PARTIAL REIMBURSEMENT TO HOSPITALS FOR QUALIFYING
1.4AVOIDABLE PATIENT DAYS.
1.5    Subdivision 1. Definitions. (a) For purposes of this section, the following terms have
1.6the meanings given.
1.7(b) "High-acuity patient" means a hospital patient with obesity or who has a disability,
1.8has a need for wound care, has a mental illness, has high behavior needs, has a substance
1.9use disorder, is receiving intravenous fluid or intravenous medication, or requires dialysis.
1.10(c) "Qualifying avoidable patient day" means:
1.11(1) any day a high-acuity patient was boarded in an emergency department because the
1.12patient did not meet the applicable admission criteria and the hospital could not identify a
1.13setting to which the patient could be safely released; or
1.14(2) every day after the seventh consecutive day on which a high-acuity patient was
1.15eligible for discharge from the hospital, but the hospital could not identify any setting to
1.16which the patient could be safely discharged.
1.17    Subd. 2. Partial reimbursement to hospitals. (a) Beginning July 1, 2023, the
1.18commissioner of human services shall make payments to hospitals as partial reimbursement
1.19for qualifying avoidable patient days. The commissioner shall make payments of up to
1.20$1,400 per submitted qualifying avoidable patient day.
1.21(b) By June 15, 2023, a hospital seeking a payment under this section must submit to
1.22the commissioner of human services the total number of qualifying avoidable patient days
1.23at the hospital between January 1, 2023, and May 31, 2023. To determine the payment
2.1amount for each qualifying avoidable patient day, the commissioner must divide the
2.2appropriation available for this purpose by the number of submitted qualifying avoidable
2.3patient days. If a portion of the available appropriation remains after all payments have been
2.4made based on the initial submission of qualifying avoidable patient days, the commissioner
2.5must solicit the submission by hospitals of additional qualifying avoidable patient days
2.6between June 1, 2023, and a date to be determined by the commissioner that the
2.7commissioner estimates will result in the complete expenditure of the available appropriation
2.8after making payments that closely approximate the amount of the original round of
2.9payments.
2.10(c) When making payments under this section, the commissioner must not consider the
2.11source of reimbursement for the services provided to the high-acuity patient.
2.12EFFECTIVE DATE.This section is effective the day following final enactment."

2.14    "Subd. 5. Payments to hospitals. $18,000,000 in fiscal year 2024 is appropriated from
2.15the general fund to the commissioner of human services for payments to hospitals for partial
2.16reimbursement for qualifying avoidable patient days."
