"Section 1.  [124D.995] UNEMPLOYMENT INSURANCE AID.

 

(a) School districts and charter schools, including intermediate school districts and other cooperative units under section 123A.24, subdivision 2, are eligible to receive unemployment insurance aid under this section.  For each fiscal year, an eligible entity's aid is the difference between:

 

(1) net audited unemployment costs, as reported under section 123B.76, for the prior fiscal year; and

 

(2) the base period net audited unemployment costs pursuant to paragraph (b).

 

(b) The base period net audited unemployment costs equals the eligible entity's fiscal year 2022 net audited unemployment costs.

 

(c) If the total eligible unemployment insurance aid for a fiscal year is greater than the annual appropriation for that year, the commissioner must proportionately reduce the aid payment to each eligible entity.

 

EFFECTIVE DATE.  This section is effective for aid beginning in fiscal year 2025.

 

Sec. 2.  Minnesota Statutes 2022, section 126C.43, subdivision 2, is amended to read:

 

Subd. 2.  Payment to unemployment insurance program trust fund by state and political subdivisions.  (a) A district may levy the amount necessary (1) to pay the district's obligations under section 268.052, subdivision 1, and (2) to pay for job placement services offered to employees who may become eligible for benefits pursuant to section 268.085 for the fiscal year the levy is certified.

(b) Districts with a balance remaining in their reserve for reemployment as of June 30, 2003, may not expend the reserved funds for future reemployment expenditures.  Each year a levy reduction must be made to return these funds to taxpayers.  The amount of the levy reduction must be equal to the lesser of:  (1) the remaining reserved balance for reemployment, or (2) the amount of the district's current levy under paragraph (a).

 

(c) The amount in paragraph (a) must be reduced by any amount received by the district under section 124D.995.

 

(d) A district that is a member of an intermediate school district or other cooperative unit under section 123A.24, subdivision 2, may include in its authority under this section the costs associated with qualifying obligations under paragraph (a) for the cooperative unit.  Revenue raised under this paragraph must be transferred to the cooperative unit.

 

Sec. 3.  Minnesota Statutes 2022, section 127A.45, subdivision 12, is amended to read:

 

Subd. 12.  Payment percentage for certain aids.  One hundred percent of the aid for the current fiscal year must be paid for the following aids:  reimbursement for enrollment options transportation, according to sections 124D.03, subdivision 8, and 124D.09, subdivision 22, and chapter 124E; school lunch aid, according to section 124D.111; and support services aid, for persons who are deaf, deafblind, and hard-of-hearing according to section 124D.57; and unemployment insurance aid according to section 124D.995."

Sec. 2.  Minnesota Statutes 2022, section 327C.015, is amended by adding a subdivision to read:

 

Subd. 11a.  Public utility.  "Public utility" has the meaning given in section 216B.02, subdivision 4.

 

EFFECTIVE DATE.  This section is effective the day following final enactment.

 

Sec. 3.  Minnesota Statutes 2022, section 327C.015, subdivision 17, is amended to read:

 

Subd. 17.  Substantial modification.  "Substantial modification" means any change in a rule which:  (a) significantly diminishes or eliminates any material obligation of the park owner; (b) significantly diminishes or eliminates any material right, privilege or freedom of action of a resident; or (c) involves a significant new expense for a resident.  The installation of water meters and the subsequent metering and billing for water service is not a substantial modification of the lease, provided the park owner complies with section 327C.04, subdivision 6.

 

EFFECTIVE DATE.  This section is effective for meter installations initiated on or after August 1, 2023.

 

Sec. 4.  Minnesota Statutes 2022, section 327C.015, is amended by adding a subdivision to read:

 

Subd. 17a.  Utility provider.  "Utility provider" means a public utility, an electric cooperative association, or a municipal utility.

 

EFFECTIVE DATE.  This section is effective the day following final enactment.

 

Sec. 5.  Minnesota Statutes 2022, section 327C.015, subdivision 18, is amended to read:

 

Subd. 18.  Utility service.  "Utility service" means any electric, fuel oil, natural or propane gas, sewer, waste disposal and water service by whatever means furnished that is provided by a utility provider.

 

EFFECTIVE DATE.  This section is effective the day following final enactment.

Sec. 6.  Minnesota Statutes 2022, section 327C.04, subdivision 1, is amended to read:

 

Subdivision 1.  Billing permitted.  A park owner who provides utility service to residents that is provided to the park owner by a public utility, a cooperative electric association, or a municipal utility may charge the residents for that service, only if the charges comply with this section.

 

EFFECTIVE DATE.  This section is effective the day following final enactment.

 

Sec. 7.  Minnesota Statutes 2022, section 327C.04, subdivision 2, is amended to read:

 

Subd. 2.  Metering required.  A park owner who charges residents for a utility service must charge each household the same amount, unless the park owner has installed measuring devices which accurately meter each household's use of the utility.  Utility measuring devices installed by the park owner must be installed or repaired only by a licensed plumber, licensed electrician, or licensed manufactured home park installer.

 

EFFECTIVE DATE.  This section is effective August 1, 2023, for all meters installed or repaired on or after that date.

 

Sec. 8.  Minnesota Statutes 2022, section 327C.04, is amended by adding a subdivision to read:

 

Subd. 5.  Utility charge for metered service.  (a) A park owner may not charge or collect from a resident utility service consumed at a commodity rate that is greater than the commodity rate at which the park owner purchases service from a utility provider.  The park owner must deduct the amount that reflects consumption that exclusively or primarily is for the park owner's purposes.

 

(b) If a bill a park owner receives from a utility provider separates a fixed service or meter charge or fee from variable consumption charges, the park owner must deduct the park owner's pro rata share and apportion the remaining fixed portion of the bill equally among residents based on the number of units in the park.

 

(c) If a bill a park owner receives from a utility provider separately itemizes taxes, surcharges, and other miscellaneous charges other than a fixed service charge and variable consumption charges, the park owner must deduct the park owner's pro rata share and apportion the remaining portion of the bill reflecting the taxes, surcharges, and other miscellaneous charges equally among residents based on the number of units in the park.

 

(d) A park owner may not charge to or collect from residents any administrative, capital, or other expenses, including but not limited to disconnection, reconnection, and late payment fees.

 

EFFECTIVE DATE.  This section is effective July 1, 2023.

 

Sec. 9.  Minnesota Statutes 2022, section 327C.04, is amended by adding a subdivision to read:

 

Subd. 6.  Rent increases following the installation of water meters.  A park owner may not increase lot rents for 15 months following the commencement of utility billing for a resident whose lease included water service.  In each of the three months prior to commencement of utility billing, a park owner must provide the resident with a sample bill for water services.

 

EFFECTIVE DATE.  This section is effective for meter installations initiated on or after August 1, 2023.

 

Sec. 10.  REPEALER.

 

Minnesota Statutes 2022, section 327C.04, subdivisions 3 and 4, are repealed.

 

EFFECTIVE DATE.  This section is effective July 1, 2023."

(a) $690,000 in fiscal year 2024 is appropriated from the general fund to the commissioner of administration to contract with the Board of Regents of the University of Minnesota for a grant to the Institute on the Environment to conduct research examining how projections of future weather trends may exacerbate conditions such as drought, elevated temperatures, and flooding that:

 

(1) can be integrated into the design and evaluation of buildings constructed by the state of Minnesota and local units of government so as to:

 

(i) reduce energy costs by deploying cost-effective energy efficiency measures, innovative construction materials and techniques, and renewable energy sources; and

 

(ii) prevent and minimize damage to buildings caused by extreme weather conditions, including but not limited to increased frequency of intense precipitation events and tornadoes, flooding, and elevated temperatures; and

 

(2) may weaken the ability of natural systems to mitigate those conditions to the point where human intervention in the form of the building of, or the redesign of the scale and operation of, infrastructure is required to address those conditions in order to:

 

(i) maintain and increase the amount and quality of food and wood production;

 

(ii) reduce fire risk on forested land;

 

(iii) maintain and enhance water quality; and

 

(iv) maintain and enhance natural habitats.

 

(b) The contract must provide that, no later than February 1, 2025, the director of the Institute on the Environment, or the director's designee, submit a written report to the chairs and ranking minority members of the legislative committees with primary jurisdiction over environment policy and capital investment summarizing the findings and recommendations of the research, including any recommendations for policy changes or other legislation.

 

EFFECTIVE DATE.  This section is effective the day following final enactment."

(b) If a farmed white-tailed deer tests positive using an RT-QuIC test performed on both a second ear biopsy and a tonsil or rectal biopsy, the owner must have the animal destroyed and tested for chronic wasting disease using a postmortem test approved by the Board of Animal Health.

 

(c) If a farmed white-tailed deer tests positive for chronic wasting disease under paragraph (b), the owner must depopulate the premises of farmed Cervidae as required under section 35.155, subdivision 11."

$1,632,612 in fiscal year 2024 and $1,845,700 in fiscal year 2025 are appropriated from the general fund to the Board of Regents of the University of Minnesota for chronic wasting disease contingency plans developed by the Center for Infectious Disease Research and Policy.  The center must develop, refine, and share with relevant experts and stakeholders contingency plans regarding the potential transmission of chronic wasting disease from Cervidae to humans, livestock, and other species.  The contingency plans must provide a blueprint for preparedness and response planning documents including authoritative risk communication, education, and outreach materials.  The base for this appropriation is $1,603,000 in fiscal year 2026, $1,603,000 in fiscal year 2027, and $0 in fiscal year 2028 and beyond."

Subd. 2.  Electronic attendance records.  (a) The commissioner of human services, in consultation with the commissioner of information technology, shall develop and implement an electronic attendance record system for the child care assistance program under chapter 119B.  The system must:

 

(1) use nonbiometric methods to verify the identity of individuals using the system; and

 

(2) interface with commercially available electronic attendance record systems to allow child care providers currently using commercially available systems to continue to do so.

 

(b) All costs related to developing and implementing the system, including equipment costs for child care providers, shall be paid by the commissioner of human services."
