MINUTES


Representative Mark Olson, Chair of the Local Government Committee, called the thirty-seventh meeting to order at 5:15 P.M. on Thursday, March 16, 2006, in Room 10 of the State Office Building.

The clerk noted the roll.

MARQUART, Paul moved the Minutes of March 13, 2006, be approved as corrected* by the clerk. THE MOTION PREVAILED.

Without objection the Minutes of March 15, 2006, were laid on the table.


HF3263 (Kohls) Carver county recorder, auditor, and treasure offices combined and referendum provided.

HOLBERG, Mary Liz moved to recommend HF3263 pass.

At the request of the Chief Author HOLBERG, Mary Liz moved to recommend HF3263 be amended as follows:

The Holberg Motion Prevailed.

The following provided testimony on and responded to the Committee’s questions regarding HF3263 as amended:

Representative Paul Kohls; and David Hemze, County Administrator, Carver County, 600 4th E, Chaska, MN, 55318.

There being no further testimony, pro or con, the question reoccurred on the Holberg Motion as amended to recommend HF3263 be amended, and when so amended be recommended to pass. THE MOTION PREVAILED.



HF3017 (Howes) Emergency medical services special taxing districts alternative establishment method provided, levy authority increased, and sunset removed.

CHARRON, Mike moved to recommend HF3017 pass and be re-referred to the Committee on Taxes.

The following provided testimony on and responded to the Committee’s questions regarding HF3017:

Representative Larry Howes; O.J. Doyle (12893 Floral Av, Apple Valley, MN, 55124), on behalf of the MN Ambulance Association, PO Box 823, St Cloud, MN, 56302-0823; and Kent Sulem, Attorney, MN Association of Townships, 805 Central Av E, P.O. Box 267, St. Michael, MN, 55376.

There being no further testimony, pro or con, the question reoccurred on the Charron Motion to recommend HF3017 pass and be re-referred to the Committee on Taxes. THE MOTION PREVAILED


HF3289 (Abeler) Ramsey; port authority powers granted.

PETERSON, Neil moved to recommend HF3289 pass and be re-referred to the Committee on Taxes.

The following provided testimony on and responded to the Committee’s questions regarding HF3289:

Representative Jim Abler; and Jim Norman, City Administrator, City of Ramsey, 15153 Nowthen Blvd NW, Ramsey, MN, 55303.

There being no further testimony, pro or con, the question reoccurred on the Peterson Motion to recommend HF3289 pass and be re-referred to the Committee on Taxes. THE MOTION PREVAILED


HF3027 (Charron) Nonconforming county land use provisions modified.

CHARRON, Mike moved to recommend HF3027 pass .

Representative Mike Charron provided testimony on and responded to the Committee’s questions regarding HF3027.

There being no further testimony, pro or con, the question reoccurred on the Charron Motion to recommend HF3027 pass. There being 7 ayes and 6 nays, THE MOTION PREVAILED.


HF3285 (Holberg) Metropolitan council review of school district capital improvement programs requirement repealed.

HORNSTEIN, Frank moved to recommend HF3285 pass.

The following provided testimony on and responded to the Committee’s questions regarding HF3285:

Representative Frank Hornstein; and Judd Schetnan, Government Affairs Director, Metropolitan Council, 230 Fifth St E, St. Paul, MN, 55101-1633.


There being no further testimony, pro or con, the question reoccurred on the Hornstein Motion to recommend HF3285 pass. THE MOTION PREVAILED.


The Chair noted, for the committee and the public, it had come to the Chair’s attention that as soon as the next meeting of the Committee a motion to reconsider the Olson Motion as amended, offered March 13, 2006, to recommend HF2867 be amended and when so amended be recommended to pass, could be forthcoming. The Chair also noted that an amendment (H2867DE2) which the Chief Author may request be offered if such a motion to reconsider prevails, is amongst the handouts the members received today.


Without objection the meeting was adjourned at 6:24 PM.

On page 90, the Olson Motion to recommend passage and placement on the Consent Calendar was in regards to HF3142, not HF3169 (corrected in 2 instances).
