Representative Carlson, Chair of the Finance Committee, called the meeting to order at
10:17 A.M. on Friday, April 4, 2008, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Rep. Sailer moved approval of the minutes of Monday, March 31, 2008. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Rep. Rukavina moved adoption of the Higher Education and Workforce Development Policy and Finance Division for SF2402, First Unofficial Engrossment. (See language at https://www.revisor.leg.state.mn.us/bin/showPDF.phphttps). THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Rukavina move that SF2402, First Unofficial Engrossment, be recommended to pass and placed on the General Register.

Rep. Atkins presented SF2402, First Unofficial Engrossment (Atkins) modifying provisions
governing the Board of Accountancy.

Robert Hyde, CPA, Minnesota Board of Accounting, testified on SF2402, First Unofficial
Engrossment.

Rep. Rukavina amended the motion that SF2402, First Unofficial Engrossment be recommended to pass and be placed on the Consent Calendar. THE MOTION PREVAILED.

Rep. Hilty moved adoption of the Energy Finance and Policy and Finance Division Report for HF3366, First Engrossment. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/HF3366.1.pdf). THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Hilty moved that HF3366 First Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Hilty moved to amend HF3366, First Engrossment. (See attached amendment A08-1574). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep.Eken presented HF3366, First Engrossment, as amended, (Eken) Petrofund program modified.

Joel Fischer, Director, Petrofund, Minnesota Department of Commerce, testified on HF3366, First Engrossment, as amended.

Rep. Hilty renewed the motion that HF3366, First Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Hilty moved adoption of the Energy Finance and Policy Division report for HF3343, First Committee Engrossment. (See attached language at http://wdoc.house.leg.state.mn.us/leg/LS85/CEH3343.1.pdf). THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Juhnke moved that HF3343, First Committee Engrossment, be recommended to pass and re- referred to the Committee on Ways and Means.

Rep. Juhnke presented HF3343, First Committee Engrossment (Juhnke) Wind energy conversion
system aggregation program and account established, and money appropriated.

Rep. Juhnke renewed the motion that HF3343, First Committee Engrossment, be recommended to pass and re- referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Hilty moved adoption of the Energy Finance and Policy Division report for HF3401 First Committee Engrossment. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/CEH3401.1.pdf). THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Hilty moved that SF2706, Second Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Hilty moved to delete the Senate language and amend the language from HF3401 First Committee Engrossment into SF2706, Second Engrossment. THE MOTION PREVAILED.

Rep. Hilty presented SF2706, Second Engrossment (Hilty) Energy usage performance standards
provided for development and application.

Rep. Hilty renewed the motion that SF2706, Second Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Hilty moved adoption of the Energy Finance and Policy Division report for HF3661 First Committee Engrossment. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/CEH3661.1.pdf). THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Hilty moved that HF3661, First Committee Engrossment, be recommended to pass and be placed on the General Register.

Rep. Hilty presented HF3661, First Committee Engrossment (Hilty) Greenhouse gas emission reduction coordinated process created.

Rep. Kalin presented HF3669, First Committee Engrossment, as amended (Kalin) Government energy conservation investment program created.

Rep. Hilty moved adoption of the Energy Finance and Policy Division report for HF3195 First Committee Engrossment. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/CEH3195.1.pdf). THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Hilty moved that HF3195 First Committee Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Hilty moved to amend HF3195, First Committee Engrossment. (See attached amendment H3195A35). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Bob Eleff, House Research responded to questions regarding HF3195, First Committee Engrossment, as amended.

Rep. Knuth presented HF3195, First Committee Engrossment, as amended, (Knuth) Greenhouse
gas emission cap and trade program principles established, studies required, and money
appropriated.

Rep. Peppin moved to amend HF3195, First Committee Engrossment, as amended. (See attached amendment H3195A33).

Chair Carlson ruled that amendment H3195A33 was out of order.

Rep. Peppin moved to amend HF3195, First Committee Engrossment, as amended. (See attached amendment H3195A34).

Rep. Kahn moved to amend the proposed amendment H3195A34, as follows:

Page 1, line 11, insert :
"No certificate of need may be issued unless the federal government has eliminated the liability limits under the Price Anderson Act"

THE MOTION PREVAILED. THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.

Edward Garvey, Deputy Commissioner, Minnesota Department of Commerce testified on HF3669, First Committee Engrossment, as amended.

Rep. Peppin withdrew H3195A34, as amended.

Rep. Peppin moved to amend HF3195, First Committee Engrossment, as amended, as follows:

Page 3, after line 10, insert: "(3) repealing the ban on issuing certificates of need for construction of new nuclear-powered electric generating plants."

Rep. Kahn moved to amend the proposed amendment as follows:

Page 1, line 11, insert :
", provided that the federal government has eliminated the liability limits under the Price Anderson Act"

A division was requested on the motion. There were 16 Ayes and 9 Nays. THE MOTION PREVAILED. THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.

Rep. Solberg moved adoption of the State Government Finance Division Report for HF3493. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/HF3493.0.pdf). THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Solberg moved that HF3493 be recommended to pass and be placed on the General Register.

Rep. Solberg presented HF3493 (Solberg) Disaster relief funding provided, state reimbursement provided, and money appropriated.

Rep. Solberg renewed the motion that HF3493 be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Rep. Hilty moved that HF3729 First Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Hilty moved to amend HF3729, First Engrossment. (See attached amendment H3729A2). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Hilty moved to amend HF3729, First Engrossment, as amended. (See attached amendment H3729A1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.


Rep. Hilty presented HF3729, First Engrossment, as amended (Hilty) Legislative Energy
Commission established, and Legislative Electric Energy Task Force abolished, conforming
corrections made, and money appropriated.

Rep. Hilty renewed the motion that HF3729 First Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

HF4143 (Thissen) A bill for an act relating to education finance; modifying health and safety revenue to include elevator repair costs; amending Minnesota Statutes 2006, section 123B.57, subdivisions 2, 6.

HF934 (Clark) A bill for an act relating to the environment; restricting the manufacture and sale of certain polybrominated diphenyl ethers; requiring a report; providing penalties; proposing coding for new law in Minnesota Statutes, chapter 325E.

To the Division on Housing Policy and Finance and Public Health Finance.
