Representative Benson, Vice-Chair of the Finance Committee, called the meeting to order at 10:21 A.M. on Monday, May 10, 2010, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Rep. Simon moved approval of the minutes of Friday, May 7, 2010. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Vice-Chair Benson moved adoption of the State Government Finance Division Report for HF2922, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Thissen moved that HF2922, First Committee Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Thissen moved to amend HF2922, First Committee Engrossment. (See attached amendment A10-2625). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Solberg moved to amend HF2922, First Committee Engrossment, as amended. (See attached amendment H2922A5). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Thissen presented HF2922, First Committee Engrossment, as amended (Thissen) Minneapolis Employees Retirement Fund; administrative functions transferred to the Public Employees Retirement Association, consolidation account created within the Public Employees Retirement Association, and money appropriated.

Rep. Thissen renewed the motion that HF2922, First Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Carlson presented a proposal for a budget balancing plan.

Bill Marx, House Fiscal Analyst, responded to questions regarding the proposed budget balancing plan.

Greg Crowe, Fiscal Analyst, responded to questions regarding the proposed budget balancing plan.

Rep. Lenczewski presented the tax implications of the proposed budget balancing plan.

Vice-Chair Benson recognized a 7th grade class from St. Stephen’s in Anoka that were visiting the Committee on Finance.

Rep. Carlson moved that HF3834 be recommended to pass and placed on the General Register.

Rep. Carlson presented HF3834 (Carlson) Minnesota Management and Budget commissioner required to provide a cash flow forecast to the governor and legislature.

Rep. Carlson renewed the motion that HF3834 be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

Vice-Chair Benson recessed the meeting at 11:51 A.M.

Vice-Chair Benson moved adoption of the Public Safety Finance Division Report for SF2891. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Vice-Chair Benson moved that SF2891 be recommended to pass and placed on the General Register.

Rep. Mullery presented SF2891 (Mullery) Interstate Compact for Juveniles adopted.

Vice-Chair Benson renewed the motion that SF2891 be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

Rep. Kahn moved adoption of the State Government Finance Division Report for SF3134, First Unofficial Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Kahn moved that SF3134, First Unofficial Committee Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Kahn presented SF3134, First Unofficial Committee Engrossment (Kahn) State government programs or activities money appropriated or reduced, and provisions changed relating to expenses of governor-elect, income earned by the permanent school fund, lease-purchase agreements, general services, resource recovery, payment of aids and credits to school districts, tax return preparers, and implied consent.

Rep. Kahn moved to amend SF3134, First Unofficial Committee Engrossment. (See attached amendment S3134A14). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Winkler moved to amend SF3134, First Unofficial Committee Engrossment, as amended. (See attached amendment S3134A18).

Mike Franklin, Director, Energy & Elections Policy and Political Action, Minnesota Chamber of Commerce, responded to questions regarding the proposed Amendment S3134A18.

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Wayne Waslaski, Senior Director, Minnesota Department of Administration, responded to questions regarding SF3134, First Unofficial Committee Engrossment, as amended.

Rep. Simon moved to amend SF3134, First Unofficial Committee Engrossment, as amended, as follows:

Rep. Kohls requested a division on the motion. There were 11 Ayes and 8 Nays. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.


Beth Fraser, Director of Governmental Affairs, Minnesota Office of Secretary of State, responded to questions regarding SF3134, First Unofficial Committee Engrossment, as amended.

Rep. Kahn renewed the motion that SF3134, First Unofficial Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Kahn moved adoption of the State Government Finance Division Report for HF2866, First Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Carlson moved that HF2866, First Engrossment, be recommended to pass and placed on the General Register.

Rep. Carlson moved to amend HF2866, First Engrossment. (See attached amendment H2866A2). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Carlson presented HF2866, First Engrossment, as amended (Carlson) Executive branch authority modified to reduce unexpended allotments.

Bob Carney, Jr., Citizen, testified on HF2866, First Engrossment, as amended.

Rep. Carlson renewed the motion that HF2866, First Engrossment, as amended, be recommended to pass and placed on the General Register.

Rep. Winkler requested a roll call on the motion.

Voting Aye: Carlson, Benson, Champion, Hilty, Juhnke, Kahn, Knuth, Paymar, Simon, Solberg, Winkler

Voting Nay: Brod, Buesgens, Emmer, Garofalo, Kiffmeyer, Kohls, Peppin, Shimanski
