MINUTES


Representative Kahn, Chair of the Division, called the meeting to order at 2:55 P.M. on March 11, 2010 in Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Representative Kath moved that the minutes of March 9, 2010 be adopted. THE MOTION PREVAILED.

HF 3449 - State government programs or activities money appropriated or reduced, and provisions changed relating to expenses of governor-elect, income earned by the permanent school fund, lease-purchase agreements, general services, resource recovery, payment of aids and credits to school districts, tax return preparers, and implied consent.

Chair Kahn moved that HF 3449 be recommended to pass and be re-referred to the Finance Committee.

Chair Kahn moved the A10-2310 delete-everything amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved the H3449A20 amendment to HF 3449 the delete everything amendment (A10-2310). THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved the H3449A22 amendment to HF 3449 the delete everything amendment (A10-2310). THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Helen Roberts, House Fiscal Analyst, gave an overview of the Chair’s recommended change items to the Governor’s proposed 2010 supplemental budget.

Mark Shepard, House Research, gave an overview of the A10-2310 delete everything amendment to HF 3449.


Jim Gelbman, Deputy Secretary, Office of the Secretary of State, responded to member questions.

Mr. Shepard continued with his overview of the delete-everything amendment.

Jim Rhodes and Dave Fielding, both from the Department of Administration, responded to member questions.

Rose Hennessy-Allen, Pension Director, Office of State Auditor, responded to member questions.

Greg Tschida, CIO Office, Department of Revenue, responded to member questions.

Lead Republican Peppin moved an oral amendment to HF 3449 the delete everything amendment (A10-2310) as follows:

Page 19, line 31, after "on" insert "acceptable"
Page 19, line 32, delete "2011" and insert "2012"
Page 19, line 35, delete "January" and insert "July"

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Beth Frasier, Director of Government Affairs, and Mr. Gelbman, both from the Secretary of State’s office responded to member questions.

Representative Kiffmeyer moved an oral amendment to HF 3449 the delete everything amendment (A10-2310) as follows:

Page 9, delete lines 15-23

Michael Muilenburg, Director of Legislative Affairs, Office of Enterprise Technology, responded to member questions.

Chair Kahn moved a recess to the call of the Chair.

Chair Kahn reconvened the meeting at 4:56 P.M. in Room 400S of the State Office Building.

Chair Kahn moved the MS146 amendment to HF 3449 the delete everything amendment (A10-2310). THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Curt Yoakum, Director of Legislative Affairs, Minnesota Management and Budget, responded to member questions.

Chair Kahn moved the MS149 amendment to HF 3449 the delete everything amendment (A10-2310). THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Kiffmeyer moved the H3449A8 amendment to HF 3449 the delete everything amendment (A10-2310).

Abigail Reed, Executive Budget Officer, Minnesota Management and Budget, responded to member questions.

Representative Downey moved the following oral amendment to the H3449A8 amendment:

Page 2, line 3, delete "an itemized" and insert "a total"
Page 2, line 7, delete "an" and insert "a total"

Representative Kiffmeyer incorporated the Downey oral amendment into her H3449A8 amendment.

Representative Kiffmeyer renewed her motion that H3449A8 amendment, as amended, be adopted. THE MOTION DID NOT PREVAIL AND THE AMENDMENT WAS NOT ADOPTED.

Lead Republican Peppin requested a division vote. The results were 4 AYES and 6 NAYS. THE MOTION DID NOT PREVAIL AND THE AMENDMENT WAS NOT ADOPTED.

Representative Downey moved the H3449A9 amendment to HF 3449 the delete everything amendment (A10-2310). He then incorporated the following oral amendment to his A9 amendment:

Page 7 of the A10-2310 delete-everything amendment, line 13, after "travel" insert "fleet management,"
Page 7 of the A10-2310 delete-everything amendment, line 15, after "functions" insert "or through other operational efficiencies"

Sheila Reger, Commissioner, and Tim Morse, Director, both from the Department of Administration, responded to member questions.

Representative Downey renewed his motion that the H3449A9 amendment, as amended, be adopted. THE MOTION PREVAILED AND THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Representative Kalin moved an oral amendment to HF 3449 the delete everything amendment (A10-2310) as follows:


Page 7, line 14, after "buildings," insert "including a move to daytime cleaning"

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Kalin moved the H3449A15 amendment to HF 3449 the delete everything amendment (A10-2310). After some discussion, Representative Kalin withdrew his amendment.

Representative Kalin moved the H3449A10 amendment to HF 3449 the delete everything amendment (A10-2310). He then incorporated the following oral amendment to his amendment:

Page 1, line 8, delete "$77" and insert "$96"

Rebecca Spartz, Attorney General’s Office, responded to member questions.

Representative Kalin renewed his motion that the H3449A10 amendment, as amended, be adopted. THE MOTION PREVAILED AND THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Representative Downey moved the H3449A11 amendment to HF 3449 the delete everything amendment (A10-2310).

Chair Kahn moved the following oral amendment to the A-11 amendment:

Page 1, line 5, delete "provide the" and insert "produce a"
Page 1, line 6, delete "legislature with a"

Representative Downey incorporated the oral amendment into his A-11 amendment.

Representative Downey renewed his motion that H3449A11, as amended, be adopted.
THE MOTION PREVAILED AND THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Representative Downey moved the following oral amendment to HF 3449 the delete everything amendment (A10-2310) as follows:

Page 2, delete lines 1 to 25 and insert:

Representative Downey moved the H3449A12 amendment to HF 3449 the delete everything amendment (A10-2310). THE MOTION DID NOT PREVAIL AND THE AMENDMENT WAS NOT ADOPTED.

Vice-Chair Winkler moved the H3449A17 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

*Chair Kahn noted for the record that she voted "NAY".

Representative Kalin moved the H3449A16 amendment to HF 3449 the delete everything amendment (A10-2310). THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Vice-Chair Winkler moved the H3449A19 amendment to HF 3449 the delete everything amendment (A10-2310) THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Lead Republican Peppin moved the H3449A18 amendment to HF 3449 the delete everything amendment (A10-2310). After some discussion, Lead Republican Peppin withdrew her amendment.

Representative Sanders moved the H3449A21 amendment to HF 3449 the delete everything amendment (A10-2310).

Michael Muilenburg, Director of Legislative Affairs, Office of Enterprise Technology, responded to member questions.

Representative Sanders renewed his motion that the A-21 amendment be adopted. THE MOTION DID NOT PREVAIL AND THE AMENDMENT WAS NOT ADOPTED.

Chair Kahn moved the following handwritten amendment to HF 3449 the delete everything amendment (A10-2310) as follows:

Page 8, delete Sec. 2, and insert:

Sec. ___ HELP AMERICA VOTE ACT.
(a) If the secretary of state determines that this state is otherwise eligible to

receive an additional payment of federal money under the Help America Vote Act, Public Law 107-252, the secretary must certify to the commissioner of management and budget the amount, if any, needed to meet the matching requirement of section 253(b)(5) of the Help America Vote Act. In the certification, the secretary shall specify the portion of the match that should be taken from an unencumbered general fund appropriation to the Office of the Secretary of State for a different purpose. Upon receipt of that certification, or as soon as an unencumbered general fund appropriation becomes available, whichever occurs later, the commissioner must transfer the specified amount to the Help America Vote Act account. This paragraph expires on June 30, 2011.

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn renewed her motion that HF 3449 be recommended to pass, as amended, and be re-referred to the Finance Committee.
