CIVIL JUSTICE POLICY COMMITTEE MINUTES



Representative Mullery, Chair, called the meeting to order at 8:32 A.M. on Wednesday, February 18, 2009, in Room 10 of the State Office Building.

The Legislative Assistant noted the roll.

Representative Olin moved approval of the Minutes for the joint hearing of the Civil Justice Committee and the Crime Victims and Criminal Records Division on February 16, 2009. THE MOTION PREVAILED.

HF332-1E (Kulick Jackson): A bill for an act relating to real property; making clarifying, technical, and conforming changes to transfer on death deeds; expanding common element certificates of title to include planned communities; exempting designated transfers from certain requirements; establishing procedures for cartways in cities; modifying power of attorney provision relating to real property transactions; amending Minnesota Statutes 2008, sections 272.115, subdivision 1, by adding a subdivision; 435.37, by adding a subdivision; 507.071, subdivision 20, by adding a subdivision; 507.092, subdivisions 1, 2; 508.351; 508.50; 508A.351; 508A.50; 523.17, by adding a subdivision.

Representative Kulick Jackson moved that HF332-1E be recommended to pass, and when so passed, be placed on the General Register.

HF497 (Mullery): A bill for an act relating to government data practices; authorizing access to certain firearm data by parole and probation authorities; amending Minnesota Statutes 2008, section 13.87, by adding a subdivision.

Representative Mullery moved that HF497 be recommended to pass, and when so passed, be re-referred to the Public Safety Policy and Oversight Committee.

Representative Mullery presented his bill.

HF731 (Mullery): A bill for an act relating to civil actions; modifying civil liability for labor and sex trafficking crimes; proposing coding for new law in Minnesota Statutes, chapter 299A; repealing Minnesota Statutes 2008, section 609.284, subdivision 2.

Representative Mullery moved adoption of the A1 amendment. THE MOTION PREVAILED.

Representative Olin moved to table the bill.
Representative Drazkowski called for a Division. There being 4 Ayes and 6 Nays, THE MOTION DID NOT PREVAIL.

Representative Hortman moved to reconsider the A1 amendment previously adopted by the committee. THE MOTION WAS WITHDRAWN.

Representative Hortman moved that HF731 be re-referred without recommendation to the Public Safety Policy and Oversight Committee, with the further recommendation that it be re-referred to the Crime Victims and Criminal Records Division. THE MOTION WAS WITHDRAWN.

Representative Olin moved to reconsider the A1 amendment previously adopted by the committee. THE MOTION PREVAILED.

Representative Holberg moved that the A1 amendment previously adopted by the committee be removed from the bill. THE MOTION PREVAILED.

Representative Hortman moved to orally amend HF731 as follows:

Page 1, line 9, delete everything after the period.

Page 1, delete lines 10 and 11

Page 1, delete everything through the period

THE MOTION PREVAILED.
