CIVIL JUSTICE POLICY COMMITTEE MINUTES



Representative Mullery, Chair, called the meeting to order at 8:30 A.M. on Wednesday, March 18, 2009, in Room 10 of the State Office Building.

The Legislative Assistant noted the roll.

Representative Kulick Jackson moved approval of the Minutes for March 16, 2009. THE MOTION PREVAILED.

HF166, the First Engrossment (Sanders): A bill for an act relating to consumer protection; prohibiting retail sales of toys that have been recalled for safety reasons; proposing coding for new law in Minnesota Statutes, chapter 325F.

Representative Scott moved HF166, the First Engrossment, before the committee.

Representative Sanders presented his bill.

Representative Scott moved that HF166, the First Engrossment, be recommended to pass and when so passed be placed on the General Register. THE MOTON PREVAILED.

HF403, the Second Engrossment (Gardner): A bill for an act relating to environment; requiring plastic yard waste bags to be compostable; establishing biodegradable and compostable standards for certain plastics; providing civil penalties; amending Minnesota Statutes 2008, section 115A.931; proposing coding for new law in Minnesota Statutes, chapter 325E.

Representative Mahoney moved HF403, the Second Engrossment, before the committee.

Representative Mahoney moved adoption of the H0403A5 amendment. THE MOTION PREVAILED.

Representative Gardner presented his bill.

Representative Mahoney moved that HF403, the Second Engrossment, as amended, be recommended to pass and when so passed be re-referred to the Committee on Finance. THE MOTION PREVAILED.

HF239, the First Engrossment (Gardner): A bill for an act relating to real estate; permitting homeowners to recover certain damages incurred due to faulty construction; amending Minnesota Statutes 2008, section 327A.05

Representative Mahoney moved HF239, the First Engrossment, before the committee.

Representative Gardner presented his bill.

Representative Mahoney moved that HF239, the First Engrossment, be recommended to pass and when so passed be placed on the General Register. THE MOTION PREVAILED.

HF702 (Hilstrom): A bill for an act relating to public safety; requiring the collection and reporting of specified summary data relating to decisions that affect a child’s status within the juvenile justice system; proposing coding for new law in Minnesota Statutes, chapter 260B.

Representative Hilstrom presented her bill and moved that HF702 be recommended to pass, and when so passed be re-referred to the Committee on Finance, with the further recommendation that the bill be re-referred to the Public Safety Finance Division.

HF720 (Hilstrom): A bill for an act relating to crimes; adopting the Uniform Child Witness Testimony by Alternative Methods Act; amending Minnesota Statutes 2008, section 595.02, subdivisions 3, 4; proposing coding for new law in Minnesota Statutes, chapter 595.

Representative Hilstrom presented her bill, and moved that HF720 be recommended to pass and when so passed be placed on the General Register.
