Representative Joe Atkins, Chair of the Commerce and Labor Committee, called the meeting to order at 4:38 P.M. on March 31, 2009, in the Basement Hearing Room of the State Office Building.

The Committee Legislative Assistant noted the roll.

HF 1038 (Jackson) Public Utilities Commission authorized to order refunds of unlawful utility rate revenues.

Representative Johnson moved the Committee Report on HF 1038 be adopted. THE MOTION PREVAILED.

Representative Atkins moved to orally amend the H1853A7 amendment as follows:
After line 3.34, insert:

Lines 43.5 and 43.6, delete the new language

Line 51.23 after "APPLICATION.", insert: "(a) Section 20 is effective for all policies with policy years beginning on or after May 21, 2009."

Line 44.11 before "." insert: "; and (5) in the case of an individual or group health insurance policy, offering incentives to individuals for taking part in preventive health care services, medical management incentive programs, or activities designed to improve the health of the individual".

Delete lines 1.3 through 1.16. THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.
