MINUTES


Karla Bigham, Vice- Chair of the Public Safety Policy & Oversight Committee, called to order the twenty-fifth meeting of the House Public Safety Policy & Oversight Committee at 1:02 pm on Thursday, April 2, 2009 in the Basement of the of the State Office Building, a quorum was present.

The Committee Legislative Assistant noted the roll.

Agenda:

Vice-Chair Bigham called for a motion to approve the minutes of March 26, 2009, as corrected by the committee legislative assistant.

Rep. Olin moved to adopt the minutes of March 26, 2009, as corrected by the committee legislative assistant.
THE MOTION PREVAILED AND THE MINUTES WERE ADOPTED.

HF108: Committee Engrossment 1(Norton): Seat belt violation made a primary offense in all seating positions regardless of age.

Chair Bigham moved that HF108 Committee Engrossment 1 be recommended to pass and be re-referred to the Committee on Finance.

Rep. Cornish moved to amend HF108 CE-1 (see H0108A7).

Rep. Cornish described the H0108A7 amendment.

Rep. Cornish renewed his motion to amend HF108 CE-1.
THE MOTION PREVAILED.

Rep. Lesch called for division.

There being 8 AYES and 6 NAYS,
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Norton presented HF108 CE-1 as amended, and took questions from the committee.

HF1947 (Lesch): Statewide Minnesota prescription program established, use of tamper-resistant prescription drug forms required, and money appropriated.

Rep. Lesch moved that HF1947 be recommended to pass and be re-referred to the Committee on Finance, with a recommended re-referral to the Committee on Health Care & Human Services Finance.

Rep. Lesch presented HF1947 and took questions from the committee.

John Harden, Prescriptions for Standard Register, testified in support of HF1947 and took questions from the committee.

Sarah Noznesky, Minnesota Medical Association, testified on HF1947 and took questions from the committee.

Rep. Lesch renewed his motion that HF1947 be recommended to pass and be re-referred to the Committee on Finance, with a recommended re-referral to the Committee on Health Care & Human Services Finance.

HF7, First Engrossment (Winkler): Laws prohibiting misuse of state funds clarified and strengthened.

Chair Hilstrom moved that HF7, En.1 be recommended to pass and be re-referred to the Committee on Finance.

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

HF1719 First Engrossment (Atkins): Viatical settlements regulated, and Viatical Settlements Model Act of the National Association of Insurance Commissions enacted and modified.

Chair Hilstrom moved that HF1719 En.1 be recommended to pass and be re-referred to the General Register.

Chair Hilstrom moved to amend HF1719 En.1 (see A09-0316).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Hilstrom moved to orally amend HF1719 En.1 as follows:
Page 4, line 22, insert "A" after "144"
THE MOTION PREVAILED AND THE ORAL AMENDMENT WAS ADOPTED.

Rep. Zellers presented HF1719 En.1 on behalf of Rep. Atkins, and took questions from the committee.

Chair Hilstrom renewed her motion that HF1719 En.1 be recommended to pass as amended, and be re-referred to the General Register.

HF1394 First Engrossment (Hayden): Real property; notice requirements specified, reduced redemption period for abandoned property and public nuisances provisions modified, a duty to protect vacant foreclosed property established, failure to maintain property fines imposed, construction site trespassing posting requirements altered, civil and criminal penalties imposed.

Rep. Hayden presented HF1394 En. 1 and took questions from the committee.
Lisa Godon, Minneapolis Attorney’s Office, testified in support of HF1394 and took questions from the committee.

Chair Hilstrom moved that HF1394 be recommended to pass and be re-referred to the General Register.

Chair Hilstrom moved to amend HF1394 (see H1394A4).

HF1457 (Johnson): Unfunded mandates affecting local governmental units eliminated.

Rep. Johnson moved that HF1457 be recommended to pass and be re-referred to the General Register.

Rep. Johnson moved to amend HF1457 (see A09-0347).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Johnson moved to reconsider the A09-0347 amendment.

Ryan Erdmann, Minnesota Association of Community Corrections Act Counties, testified in support of HF1457 and took questions from the committee.

HF1609 (Smith): Forensic Laboratory Advisory Board duties and responsibilities modified, investigation report’s public availability clarified, Department of Administration required to provide office space and services to the board, money appropriated.

Chair Hilstrom moved that HF1609 be recommended to pass and be re-referred to the Committee on Finance, with a recommended re-referral to the Committee on Public Safety Finance.

Rep. Smith presented HF1609 and took questions from the committee.

Chair Hilstrom moved to orally amend HF1609 as follows:
Page 1, line 4: delete the immunity clause, and;
Delete Page 3, line 18 through Page 3, line 23
THE MOTION PREVAILED AND THE ORAL AMENDMENT WAS ADOPTED.

Fred Dolesju, Forensic Laboratory Advisory Board, testified in support of HF1609 and took questions from the committee.

Chair Hilstrom renewed her motion that HF1609 be recommended to pass as amended, and be re-referred to the Committee on Finance, with a recommended re-referral to the Committee on Public Safety Finance.

HF545 First Engrossment (Champion): Civil rights restoration notice required.

Rep. Paymar moved that HF545 En. 1 be recommended to pass and be re-referred to the General Register.
