MINUTES

Representative Hamilton, Chair of the Agriculture & Rural Development Policy & Finance Committee, called the meeting to order at 10:22 a.m. on Thursday, March 1, 2012, in the Basement Hearing Room of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Hansen moved to approve the minutes of February 28, 2012. THE MOTION PREVAILED.

Representative Anderson moved HF 2398 to pass and be re-referred to the Civil Law Committee.
Representative Anderson moved the H2398A3 amendment.
Testifying on the A3 amendment was:
Representative Paul Anderson
Greta Gauthier, Minnesota Department of Agriculture.
The committee delayed discussion to obtain more information.

Representative Anderson moved the H2398A5 amendment.
Representative Anderson moved an oral amendment on page 29, line 29.26 to delete "signature of warehouse operator."
Representative Anderson rescinded the motion.
Representative Anderson moved an oral amendment to insert on page 29, line 29.26 after the sentence ending with"numbered" the sentence "Electronic scale tickets do not require a signature." and to insert on line 29.33 the word "paper" before the second instance of the
word "scale."

THE MOTION PREVAILED. THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.



Representative Vogel moved H2398A7. Representative Vogel moved to amend the A7 amendment to insert on page 1, after line 15, "Effective date: This section is effective retroactive from January 1, 2012 and applies to commercial feed inspection fees assessed by the commissioner of agriculture for calendar years 2012 and beyond."

Representative Hamilton moved an oral amendment.
On page 14, line 14.4 after the period, insert "Only the definitions in this subdivision apply to Chapters 25 and 32. The enforcement provisions in this chapter do not apply to violations of Chapters 25 and 32.
On page 19, line 19.30 after the period, insert "The enforcement provisions in this chapter do not apply to violations of Chapters 25 and 32."
THE AMENDMENT PREVAILED. THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.

Representative Anderson renewed his motion to pass HF 2398 as amended and re-refer it to the Civil Law Committee. THE MOTION PREVAILED.
