MINUTES

Representative Gottwalt, Chair, of the Health and Human Services Reform Committee, called the meeting to order at 2:31 P.M. on March 8, 2011, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

HF480 (Sclaze) Electronic prescribing requirements effective date extended for certain providers.
Representative Gottwalt moved that HF480 be recommended to pass.
Representative Scalze, James Allen, M.D., James Golden, Director, Health Policy Division, Minnesota Department of Health and Twila Brase, President, Citizen's Council for Health Freedom testified on HF480.
Representative Gottwalt laid HF480 on the table for possible inclusion in the Health and Human Services Reform Omnibus bill.
Representative Mack assumed the gavel at 2:55 P.M.
HF200 (Gottwalt) Alzheimer's disease data collection and reporting required.
Representative Gottwalt moved that HF200 be recommended to pass and be re-referred to the Committee on Health and Human Services Finance.
Representative Gottwalt moved the H0200D12 amendment. THE AMENDMENT WAS ADOPTED.
Representative Gottwalt, Kathleen Harrington, Chair of the Minnesota Board on Aging, Mary Birchard, Executive Director, Alzheimer’s Association, Twila Brase, and President Citizen’s Council for Health Freedom, Dr. Karen Effram and Don Lee testified on HF200.
Representative Liebling requested a roll call. The results were as follows:
Voting YEA were Representatives:
Gottwalt, Mack, Abeler, Barrett, Benson, Fritz, Gruenhagen, Hosch, Huntley, Kiffmeyer, Liebling, Loeffler, McDonald, McElfatrick, Moran, Murphy, Norton, Peterson, Quam.
Voting NAY were Representatives:
Franson, Lohmer
On a vote of 19 YAES and 2 NAYS THE MOTION PREVAILED.
Representative Gottwalt assumed the gavel at 3:32 P.M.
HF447( Kelly) Investigation, review, and hearing governing provisions modified, crime of criminal abuse of a vulnerable adult made a registrable offense under the predatory offender registration law, terminology changed, criminal penalty increased for assaulting a vulnerable adult, and criminal penalties provided.
Representative Gottwalt moved that HF447 be recommended to pass and be re-referred to the committee on Public Safety and Crime Prevention Policy and Finance.
Representative Gottwalt moved the H0447DE1 amendment. THE AMENDMENT WAS ADOPTED.
Representative Gottwalt moved the H0447DE2 amendment. THE AMENDMENT WAS ADOPTED.
Representative Kelly, Iris Freeman, Associate Director, Center for Elder Justice and Policy, William Mitchell College of Law, Candace Ballstad, LSW, FIACGC Program Coordinator, Carmen Castaneda, MSW, LICSW, Human Services Program Manager, Hennepin County Human Services and Public Health Department, Jerry Keaber, Department of Human Services, and Nichole Villaciarao, Disability Advocate testified on HF447.
Representative Gottwalt renewed his motion that HF447, as amended, be recommended to pass and be re-referred to the Public Safety and Crime Prevention Policy and Finance. THE MOTION PREVAILED.
HF468 (Gruenhagen) Expenditure of state funds prohibited to comply with federal health care laws.
Representative Gruenhagen moved that HF468 be recommended to pass and be re-referred to the Committee on Health and Human Services Finance.
Representative Huntley moved the H0468A2 amendment and requested a roll call. The vote was as follows:
Voting YEA were Representatives Fritz, Huntley, Liebling, Loeffler, Moran, Murphy, Norton, and Peterson
Voting NAY were Representatives Gottwalt, Mack, Abeler, Barrett, Benson, Franson, Gruenhagen, Kiffmeyer, Lohmer, McDonald, McElfatrick, and Quam.
On a vote of 8 AYES and 12 NAYS THE AMENDMENT WAS NOT ADOPTED.
Representative Huntley moved the H0468A3 amendment.
Representative Kiffmeyer moved to orally amend the H0468A3 amendment as follows: L. 1.4 after (b) insert "realizing this is an unfunded mandate"
A roll call was requested by Representative Liebling. The results were as follows:
Voting YEA were Representatives Gottwalt, Mack, Abeler, Barrett, Benson, Franson, Gruenhagen, Kiffmeyer, Lohmer, McDonald, McElfatrick and Quam.
Voting NAY were Representatives Fritz, Huntley, Liebling, Loeffler, Moran, Murphy, Norton, and Peterson. On a vote of 12 AYES and 8 NAYS THE ORAL AMENMENT TO THE H0468A3 AMENDMENT WAS ADOPTED.
Representative Huntley requested a roll call on the amended H0468A3 amendment, as amended. The results were as follows:
Voting AYE were Representatives Fritz, Huntley, Liebling, Loeffler, Moran, Murphy, Norton, Peterson and Quam.
Voting NAY were Representatives Gottwalt, Mack, Abeler, Barrett, Benson, Franson, Gruenhagen, Kiffmeyer, Lohmer, McDonald, and McElfatrick.
On a vote of 9 AYES and 11 NAYS THE AMENDMENT WAS NOT ADOPTED.
Representative Huntley moved the H0468A4 amendment.
Representative Kiffmeyer moved to orally amend the H0468A4 amendment as follows: L. 1.4 after (b) insert "realizing this is an unfunded mandate"

On a vote of 8 AYES and 12 NAYS THE AMENDMENT WAS NOT ADOPTED.
Representative Gruenhagen, Kim Crockett, Attorney and President of the Free Market Institute, Twila Brase, President, Citizens’Council for Health Freedom, Terry McCall, Burnsville, Mary Krinkie, Minnesota Hospital Association, Lyle Clemnson, Brooklyn Park, and Leon Moe, Cottage Grove testified on HF468.

Representative Gruenhagen renewed his motion that HF468 be recommended to pass and be referred to the Committee on Health and Human Services Finance.

Representative Liebling requested a roll call. The vote was as follows:
Voting YEA were Representatives Gottwalt, Mack, Abeler, Barrett, Benson, Franson, Gruenhagen, Kiffmeyer, Lohmer, McDonald, McElfatrick and Quam.
Voting NAY were Representatives Fritz, Huntley, Liebling, Loeffler, Moran, Murphy, Norton, and Peterson.
On a vote of 12 AYES and 8 NAYS THE MOTOIN PREVAILED.
