JUDICIARY POLICY AND FINANCE COMMITTEE

MINUTES

Representative Shimanski, Vice Chair of the Judiciary Policy and Finance Committee, called the meeting to order at 8:19 A. M. on May 3, 2011, in Room 10 (Ground Floor) of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Johnson moved approval of the April 28, 2011 Judiciary Policy and Finance Committee minutes. THE MOTION PREVAILED.

HF0718 (Champion) Civil rights restoration and civil rights possible loss notices required.

Representative Champion moved that HF0718, 1st Engrossment, as amended, be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance Committee.

Representative Champion renewed the motion that HF0718, 1st Engrossment, as amended, be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance Committee. THE MOTION PREVAILED.

HF1478 (Kiffmeyer) Minnesota sex offender program provisions modified.

Representative Gruenhagen moved that HF1478 be recommended to pass and re-referred to the Ways and Means Committee.

Representative Kiffmeyer presented HF1478.

Sheila Brandt, DHS, and Robin Vue-Benson, Department of Human Services, testified on HF1478.

Representative Gruenhagen renewed the motion that HF1478 be recommended to pass and re-referred to the Ways and Means Committee. THE MOTION PREVAILED.

HF0264 (Urdahl) Personal Responsibility in Food Consumption Act; certain persons immune from civil liability for weight gain as a result of food or nonalcoholic beverage consumption.

Representative Shimanski moved that HF0264, 1st Engrossment, be recommended to pass and placed on the General Register.

Representative Urdahl presented HF0264, 1st Engrossment.

Joel Carlson, Legal Research/Government Affairs, and Bob Johnson, Insurance Federation of Minnesota, testified on HF0264, 1st Engrossment.

Representative Shimanski renewed the motion that HF0264, 1st Engrossment, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

HF1270 (McDonald) E-charging expanded to include citations, juvenile adjudication, and implied test refusal or failure.

Representative Kriesel moved that HF1270 be recommended to pass and re-referred to the Ways and Means Committee.

Representative McDonald presented HF1270.

Katie Engler, Bureau of Criminal Apprehension, testified on HF1270.

Representative Kriesel renewed the motion that HF1270 be recommended to pass and re-referred to the Ways and Means Committee. THE MOTION PREVAILED.

HF1408 (Sanders) Vacancies in nomination procedures and requirements changed.

Representative Shimanksi moved that HF1408 be recommended to pass and placed on the General Register.

Representative Sanders presented HF1408.

Beth Fraser, Office of Secretary of State, testified on HF1408.

Representative Shimanski moved an oral amendment to HF1408. The oral amendment is as follows: Page 2, after line 33 insert new section 7. "Effective date. Sections 1 to 6 are effective the day following final enactment." THE AMENDMENT WAS ADOPTED.

Representative Shimanski renewed the motion that HF1408, as amended, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

HF1500 (Anderson) Chemical and mental health services changes made, and rate reforms made.

Representative Anderson moved that HF1500, 1st Engrossment, be recommended to pass and placed on the General Register.

Representative Anderson moved to orally amend HF1500, 1st Engrossment, as follows: Page 1, line 21, strike "one day" and insert "two days". THE AMENDMENT WAS ADOPTED.

Thomas Ruter, Department of Human Services, testified on HF1500, 1st Engrossment, as amended.

Representative Anderson moved the H1500A3-1 amendment. THE AMENDMENT WAS ADOPTED.

Representative Anderson moved to orally amend the H1500A3-1 amendment as follows: Page 2, line 35, before the period insert "unless the court, notwithstanding the parent's failure to consent, determines that the screening is in the child's best interest." THE AMENDMENT WAS INCORPORATED.

Representative Anderson moved to orally amend the H1500A3-1 amendment, as incorporated, as follows: Page 3, delete lines 26 to 28. THE AMENDMENT WAS INCORPORATED.
Representative Anderson moved the H1500A3-1 Amendment, as incorporated. THE AMENDMENT WAS ADOPTED.

Representative Anderson presented HF1500, 1st Engrossment, as amended.

Representative Anderson renewed the motion that that HF1500, 1st Engrossment, as amended, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

HF1343 (Dettmer) Immunity provided in cases involving the use of school facilities for recreational activities.

Representative Vogel moved that HF1343, 1st Engrossment, be recommended to pass and placed on the General Register.

Representative Vogel moved the H1343A3 amendment. THE AMENDMENT WAS ADOPTED.

Representative Dettmer presented HF1343, 1st Engrossment, as amended.

Rachel Callanan, American Heart Association and Joel Carlson Legal Research/Government Affairs, testified on HF1343, 1st Engrossment, as amended.

Representative Shimanski laid over HF1343, 1st Engrossment, as amended, for possible inclusion in an omnibus bill or further action at a later time.

HF1532 (Simon) Secretary of state duties imposed, and lists of registrants with challenged voting statuses due to felony convictions required.

Representative Champion moved that HF1532, 1st Engrossment, be recommended to pass and re-referred to the Civil Law Committee.

Representative Simon presented HF1532, 1st Engrossment.

Beth Fraser, Office of Secretary of State, testified on HF1532, 1st Engrossment.

Representative Shimanski laid over HF1532, 1st Engrossment, for possible inclusion in an omnibus bill or further action at a later time.
