MINUTES

Representative Hilstrom, Chair of the Committee on Judiciary Finance and Policy, called the meeting to order at 2:19 p.m. on Tuesday March 4, 2014 in Room 10 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Rep. Cornish moved to re-open the minutes from Wednesday March 20, 2013. THE MOTION PREVAILED. THE MINUTES WERE RE-OPENED.

Rep. Hilstrom moved to amend the minutes to note that Rep. Scott voted nay on HF 865. THE MOTION PREVAILED. THE MINUTES WERE AMENDED

Rep. Hortman moved approval of the minutes from Tuesday April 18, 2013. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Rep. Hilstrom moved approval of the minutes from Friday May 10, 2013. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Rep. Melin assumed the gavel at 2:22 p.m.

Rep. Hilstrom moved HF 2668 (Hilstrom), petitioners in errors and omissions petitions shall also serve the petition on all candidates for the office in which the error or omission is alleged, requirement that court seal be a raised seal eliminated, requirements for notarial act on pleadings and affidavits filed with the court in all cases removed, court documents provided to be signed under penalty of perjury, alternative service in probate matters permitted, applicants in structured settlement transfer action required to provide the court with information, request for a hearing in response to a temporary restraining order provided to be made within 20 days after the temporary restraining order is served, and application of fine payment to restitution before application to court fines permitted, be re-referred and sent to the Committee on Civil Law.

Rep. Hilstrom moved to amend HF 2668 (Hilstrom) with the A14-0804 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Hilstrom moved HF 2479 (Hilstrom), housing courts and housing calendars allowed to use referees almost exclusively for landlord and tenant cases, be re-referred to the General Register.

Rep. Hilstrom moved to amend HF 2479 (Hilstrom) with the A14-0786 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Melin moved HF 2190 (Rosenthal), business organization prefiling document review provided, and limited liability companies and business corporations regulated, be re-referred and sent to the Committee on Civil Law.

Rep. Hortman moved HF 2188, spousal real estate ownership and mortgage redemption period clarifying and conforming changes made, and transfer on death deeds modified, be re-referred and sent to the Committee on Civil Law.
