MINUTES

Representative Jim Davnie, Chair of the Education Finance Committee, called the virtual meeting to order at 8:08am on April 22, 2021 pursuant to House rule 10.01. The meeting was broadcast via Zoom and House Public Information Services.

The Committee Legislative Assistant noted the roll.

Rep. Feist moved that the minutes from April 8, 2021 be approved. Motion prevailed.

HF 600 (Winkler) This bill establishes a regulatory framework for adult-use cannabis, moves the medical cannabis program under the newly created Cannabis Management Board, establishes taxes on adult-use cannabis, creates grants to assist individuals entering into the legal cannabis market, amends criminal penalties, provides for expungement and resentencing of certain convictions, reschedules marijuana, and appropriates money.

Rep. Jordan moved that HF 600 be presented before the committee; be referred to the Public Safety Committee.

Rep. Winkler presented HF 600.

Rep. Jordan renewed the motion that HF 600 be referred to the Public Safety Committee. A roll call vote was taken. Motion prevailed.

HF 600 (Winkler): Legalization of Adult-Use Cannabis

PLEASE NOTE: Testimony, amendments and discussion will be limited to the provisions of HF 600 within the jurisdiction of the Education Finance Committee. The deadline to get amendments to the Committee Administrator is 10:30 am on Wednesday, April 21st.
The relevant provisions are as follows:
Article 1
• Sec. 4 – legislative report on funding recommendations (particularly (e) (8) (i and iv)
• Sec. 8 – prohibition of adult use on school grounds (particularly subdivision 1 sec 4)
• Sec. 14 – prohibition on business operations near a school (particularly subdivision 4)
• Sec. 46 – consumption prohibition provisions relating to medical cannabis (particularly subdivision 2)
• Sec. 47 – protections for medical cannabis registry program participants (particularly subdivision 3)

Article 5
• Sec. 5 – striking language in subdivision 1, sec. 4
• Sec. 9 – cannabis sale crimes (particularly subdivision 1, sec. 3 & 5, subdivision 2, sec. 3)

Article 7
• Sec. 3 – education on cannabis use and substance use
• Sec. 4 – reporting on underage substance use
• Sec. 5 – public health youth education on substance use (particularly subdivision 1)
• Sec. 14 – employee testing exceptions (particularly subdivision 9)
