1.4    "Sec. .... [16B.3351] PREVAILING WAGE ENFORCEMENT ON CAPITAL
1.5PROJECTS.
1.6    (a) For each project of a capital nature for which the commissioner of administration
1.7is the state contracting authority, the commissioner must ensure that the contract with
1.8each prime contractor:
1.9    (1) sets forth the specific prevailing wage for each class of laborer or mechanic
1.10working on the project and the requirements for ensuring compliance with the prevailing
1.11wage requirements;
1.12    (2) requires that each contract between a prime contractor and a subcontractor or
1.13materialman contain the same prevailing wage information and compliance requirements
1.14that is required for a contract with a prime contractor.
1.15    (b) For each project of a capital nature for which the commissioner of administration
1.16is the state contracting authority, the commissioner must require each contractor
1.17and subcontractor to submit certified payroll information to the commissioner, in a
1.18form substantially similar to that required for projects for which the commissioner of
1.19transportation is the state contracting authority. The commissioner must retain the certified
1.20payrolls for at least two years, and must provide for making this payroll information
1.21conveniently available for public inspection.
1.22    (c) The commissioner must conduct random spot checks of the certified payrolls
1.23to ensure the appropriate prevailing wage is being paid. The commissioner must also
1.24randomly interview laborers and mechanics at project sites to determine if there are any
1.25violations of prevailing wage laws.
1.26    (d) If the commissioner finds a violation of prevailing wage laws, the commissioner
1.27must work with the contractor or subcontractor to ensure that any back pay owed for
2.1prevailing wage violations is paid. If required prevailing wage payments are not paid, the
2.2commissioner must notify the commissioner of labor and industry of the violations.
2.3    (e) The commissioner's costs for enforcement of prevailing wage requirements
2.4under this section must be paid:
2.5    (1) directly from appropriations for the project; or
2.6    (2) by contractually requiring that the funds necessary to pay the commissioner's
2.7costs under this section are paid by the prime contractor, or withheld from amounts
2.8otherwise due to the prime contractor."
