1.4    "Section 101. Minnesota Statutes 2006, section 491A.02, subdivision 4, is amended to
1.5read:
1.6    Subd. 4. Representation. (a) A corporation, partnership, limited liability company,
1.7sole proprietorship, or association may be represented in conciliation court by an officer,
1.8manager, or partner or an agent in the case of a condominium, cooperative, or townhouse
1.9association, or may appoint a natural person who is an employee or commercial property
1.10manager to appear on its behalf or settle a claim in conciliation court. The state or a
1.11political subdivision of the state may be represented in conciliation court by an employee
1.12of the pertinent governmental unit without a written authorization. The state also may be
1.13represented in conciliation court by an employee of the Division of Risk Management of
1.14the Department of Administration without a written authorization. Representation under
1.15this subdivision does not constitute the practice of law for purposes of section 481.02,
1.16subdivision 8
. In the case of an officer, employee, commercial property manager, or
1.17agent of a condominium, cooperative, or townhouse association, an authorized power
1.18of attorney, corporate authorization resolution, corporate bylaw, or other evidence of
1.19authority acceptable to the court must be filed with the claim or presented at the hearing.
1.20This subdivision also applies to appearances in district court by a corporation or limited
1.21liability company with five or fewer shareholders or members and to any condominium,
1.22cooperative, or townhouse association, if the action was removed from conciliation court.
1.23    (b) "Commercial property manager" means a corporation, partnership, or limited
1.24liability company or its employees who are hired by the owner of commercial real
1.25estate to perform a broad range of administrative duties at the property including tenant
1.26relations matters, leasing, repairs, maintenance, the negotiation and resolution of tenant
1.27disputes, and related matters. In order to appear in conciliation court, a property manager's
2.1employees must possess a real estate license under section 82.20 and be authorized by the
2.2owner of the property to settle all disputes with tenants and others within the jurisdictional
2.3limits of conciliation court.
2.4    (c) A commercial property manager who is appointed to settle a claim in conciliation
2.5court may not charge or collect a separate fee for services rendered under paragraph (a)."
2.6Renumber the sections in sequence and correct the internal references
2.7Amend the title accordingly
