1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. Minnesota Statutes 2008, section 85.41, subdivision 3, is amended to read:
1.4    Subd. 3. Exemptions. (a) Participants in cross-country ski races and official school
1.5activities and residents of a state or local government operated correctional facility are
1.6exempt from the pass requirement in subdivision 1 if a special use permit has been
1.7obtained by the organizers of the event or those in an official capacity in advance from the
1.8agency with jurisdiction over the cross-country ski trail. Permits shall require that permit
1.9holders return the trail and any associated facility to its original condition if any damage
1.10is done by the permittee. Limited permits for special events may be issued and shall
1.11require the removal of any trail markers, banners, and other material used in connection
1.12with the special event.
1.13(b) Unless otherwise exempted under paragraph (a), students, teachers, and
1.14supervising adults engaged in school-sanctioned activities or other youth activities
1.15sponsored by a nonprofit organization are exempt from the pass requirements in
1.16subdivision 1.

1.17    Sec. 2. Minnesota Statutes 2008, section 85.42, is amended to read:
1.1885.42 USER FEE; VALIDITY.
1.19(a) The fee for an annual cross-country ski pass is $14 $19 for an individual age 16
1.20and over. The fee for a three-year pass is $39 $54 for an individual age 16 and over. This
1.21fee shall be collected at the time the pass is purchased. Three-year passes are valid for
1.22three years beginning the previous July 1. Annual passes are valid for one year beginning
1.23the previous July 1.
2.1(b) The cost for a daily cross-country skier pass is $4 $5 for an individual age 16 and
2.2over. This fee shall be collected at the time the pass is purchased. The daily pass is valid
2.3only for the date designated on the pass form.
2.4(c) A pass must be signed by the skier across the front of the pass to be valid and
2.5becomes nontransferable on signing.

2.6    Sec. 3. Minnesota Statutes 2008, section 85.43, is amended to read:
2.785.43 DISPOSITION OF RECEIPTS; PURPOSE.
2.8(a) Fees from cross-country ski passes shall be deposited in the state treasury and
2.9credited to a cross-country ski account in the natural resources fund and, except for the
2.10electronic licensing system commission established by the commissioner under section
2.1184.027, subdivision 15 , are appropriated to the commissioner of natural resources for
2.12the following purposes:
2.13(1) grants-in-aid for cross-country ski trails sponsored by to:
2.14(i) local units of government counties and municipalities for construction and
2.15maintenance of cross-country ski trails; and
2.16(ii) special park districts as provided in section 85.44. for construction and
2.17maintenance of cross-country ski trails; and
2.18(2) administration of the cross-country ski trail grant-in-aid program.
2.19(b) Development and maintenance of state cross-country ski trails are eligible for
2.20funding from the cross-country ski account if the money is appropriated by law."
2.21Amend the title accordingly
