1.2Delete everything after the enacting clause and insert:

1.4    Subdivision. 1. Applicability. This section applies only to common carrier railroads.
1.5    Subd. 2. Safety information. (a) In coordination with common carrier railroad
1.6companies operating in this state, the commissioner shall provide annual pesticide safety
1.7outreach opportunities for railroad employees.
1.8(b) A common carrier railroad that operates in this state must provide annual
1.9employee pesticide safety training opportunities.
1.10    Subd. 3. Pesticide applications. (a) A person may not directly apply a restricted
1.11use pesticide to occupied or unoccupied locomotives, track repair equipment, or on-track
1.12housing units unless the pesticide is specifically labeled for that use.
1.13(b) Employees of common carrier railroads must not be required to work in affected
1.14areas in a manner that is inconsistent with the pesticide label.
1.15    Subd. 4. Misuse reporting. A common carrier railroad or a commercial applicator
1.16hired by the common carrier railroad to apply pesticide must report to the commissioner
1.17within four hours, or as soon as practicable, any pesticide misuse known to the railroad
1.18company or commercial applicator that occurred on railroad property or to other property
1.19under the control of the railroad company. For the purposes of this section "misuse" means
1.20a pesticide application that violates subdivision 3 or any provision in section 18B.07."
