1.17management account and shall be used for deer and bear management programs, including
1.18a computerized licensing system.
1.19    (d) Fifty cents from each deer license is credited to the emergency deer feeding
1.20and wild cervidae health management account and is appropriated for emergency deer
1.21feeding and wild cervidae health management. Money appropriated for emergency
1.22deer feeding and wild cervidae health management is available until expended. When
1.23the unencumbered balance in the appropriation for emergency deer feeding and wild
1.24cervidae health management at the end of a fiscal year exceeds $2,500,000 for the first
1.25time, $750,000 is canceled to the unappropriated balance of the game and fish fund.
1.26The commissioner must inform the legislative chairs of the natural resources finance
2.1committees every two years on how the money for emergency deer feeding and wild
2.2cervidae health management has been spent.
2.3    Thereafter, when the unencumbered balance in the appropriation for emergency deer
2.4feeding and wild cervidae health management exceeds $2,500,000 at the end of a fiscal
2.5year, the unencumbered balance in excess of $2,500,000 is canceled and available for deer
2.6and bear management programs and computerized licensing."

2.9    "Sec. 13. Minnesota Statutes 2008, section 97A.405, subdivision 4, is amended to read:
2.10    Subd. 4. Replacement licenses. (a) The commissioner may permit licensed deer
2.11hunters to change zone, license, or season options. The commissioner may issue a
2.12replacement license if the applicant submits the original deer license and unused tags that
2.13are being replaced and the applicant pays any increase in cost between the original and
2.14the replacement license. A refund of the difference in fees may be issued when a person
2.15changes from a regular deer license to a youth deer license. When a person submits both
2.16an archery and a firearms license for replacement, the commissioner may apply the value
2.17of both licenses towards the replacement license fee.
2.18    (b) A replacement license may be issued only if the applicant has not used any
2.19tag from the original license or licenses and meets the conditions of paragraph (c). The
2.20original license or licenses and all unused tags for the licenses being replaced must be
2.21submitted to the issuing agent at the time the replacement license is issued.
2.22    (c) A replacement license may be issued under the following conditions, or as
2.23otherwise prescribed by rule of the commissioner:
2.24    (1) when the season for the license being surrendered has not yet opened;
2.25    (2) when the person is upgrading from a regular firearms or archery deer license to
2.26an all season deer license;
2.27    (3) when the person is upgrading from a regular firearms license to a multizone
2.28deer license; or
2.29    (4) when the person is changing from a regular firearms deer license to a youth
2.30deer license.
2.31    (d) Notwithstanding section 97A.411, subdivision 3, a replacement license is valid
2.32immediately upon issuance if the license being surrendered is valid at that time."

3.8is located. The holder of the license may transfer the license to the holder's spouse or
3.9dependent. Notwithstanding sections 97A.415, subdivision 1, and 97B.301, subdivision

3.12    (b) A person who obtains a license under paragraph (a) must allow public deer

5.4by a parent or guardian who possesses a small game license that was not obtained using an
5.5apprentice hunter validation; or
5.6    (4) age 12 or under and is accompanied by a parent or guardian.
5.7    (b) A resident under age 16 may take small game by trapping without a small game
5.8license, but a resident 13 years of age or older must have a trapping license. A resident
5.9under age 13 may trap without a trapping license, but may not register fisher, otter,
5.10bobcat, or pine marten unless the resident is at least age five. Any fisher, otter, bobcat,
5.11or pine marten taken by a resident under age five must be included in the limit of the
5.12accompanying parent or guardian.
5.13    (c) A resident under age 12 may apply for a turkey license and may take a turkey
5.14without a firearms safety certificate if the resident is accompanied by an adult parent or
5.15guardian who has a firearms safety certificate.
5.16    (d) A resident under age 12 may apply for a prairie chicken license and may take a
5.17prairie chicken without a firearms safety certificate if the resident is accompanied by an
5.18adult parent or guardian who has a firearms safety certificate.
5.19EFFECTIVE DATE.The amendments to paragraph (a) are effective March 1,
5.202009 2010.
5.21EFFECTIVE DATE.This section is effective retroactively from March 1, 2009."
