1.4    "Section 1. Minnesota Statutes 2008, section 116L.17, subdivision 2, is amended to
1.5read:
1.6    Subd. 2. Grants. The board shall make grants to workforce service areas or other
1.7eligible organizations to provide services to dislocated workers as follows:
1.8(a) The board shall allocate funds available for the purposes of this section in its
1.9discretion to respond to substantial layoffs and plant closings.
1.10(b) The board shall regularly allocate funds to provide services to individual
1.11dislocated workers or small groups. The initial allocation for this purpose must be 50
1.12percent of the deposits and transfers into the workforce development fund, less any
1.13collection costs paid out of the fund and any amounts appropriated by the legislature from
1.14the workforce development fund for programs other than the state dislocated worker
1.15program.
1.16(c) Following the initial allocation, the board may consider additional allocations
1.17to provide services to individual dislocated workers. The board's decision to allocate
1.18additional funds shall be based on relevant economic indicators including: the number
1.19of substantial layoffs to date, notices of substantial layoffs for the remainder of the fiscal
1.20year, evidence of declining industries, the number of permanently separated individuals
1.21applying for unemployment benefits by workforce service area, and the number of
1.22individuals exhausting unemployment benefits by workforce service area. The board must
1.23also consider expenditures of allocations to workforce service areas under paragraph (b)
1.24made during the first two quarters of the fiscal year and federal resources that have been
1.25or are likely to be allocated to Minnesota for the purposes of serving dislocated workers
1.26affected by substantial layoffs or plant closings; except that this sentence does not apply
1.27in fiscal year 2011.
2.1(d) The board may, in its discretion, allocate funds carried forward from previous
2.2years under subdivision 9 for large, small, or individual layoffs.
2.3EFFECTIVE DATE.This section is effective July 1, 2010."
