1.9    Section 1. Minnesota Statutes 2009 Supplement, section 82B.05, subdivision 1, is
1.10amended to read:
1.11    Subdivision 1. Members. The Real Estate Appraiser Advisory Board consists of
1.1215 nine members appointed by the commissioner of commerce. Three of the members
1.13must be public members, four must be consumers of appraisal services, and eight three
1.14must be real estate appraisers of whom not less than two members must be trainee real
1.15property appraisers, licensed real property appraisers, or certified residential real property
1.16appraisers, not less than two members and three must be certified general real property
1.17appraisers, and not less than one memberof those members must be certified by the
1.18Appraisal Qualification Board of the Appraisal Foundation to teach the Uniform Standards
1.19of Professional Appraisal Practice. Each of the three categories of members must include
1.20at least one member who lives or works outside of the seven-county metropolitan area.
1.21The board is governed by section 15.0575.
1.22EFFECTIVE DATE.This section is effective August 1, 2010.

1.23    Sec. 2. Minnesota Statutes 2008, section 82B.05, subdivision 5, is amended to read:
2.1    Subd. 5. Conduct of meetings. Places of regular board meetings must be decided
2.2by the vote of members. Written notice must be given to each member of the time and
2.3place of each meeting of the board at least ten days before the scheduled date of regular
2.4board meetings. The board shall establish procedures for emergency board meetings and
2.5other operational procedures, subject to the approval of the commissioner.
2.6The members of the board shall elect a chair from among the members to preside
2.7at board meetings.
2.8A quorum of the board is eight five members.
2.9The board shall meet at least once every six months as determined by a majority vote
2.10of the members or a call of the commissioner. The chair of the board may call a meeting at
2.11any other time, subject to the notice requirements of this section.
2.12EFFECTIVE DATE.This section is effective August 1, 2010.

2.13    Sec. 3. Minnesota Statutes 2008, section 82B.05, is amended by adding a subdivision
2.14to read:
2.15    Subd. 7. Enforcement reports. The commissioner shall on a regular basis provide
2.16the board with the commissioner's enforcement reports.
2.17EFFECTIVE DATE.This section is effective August 1, 2010.

2.18    Sec. 4. Minnesota Statutes 2008, section 82B.06, is amended to read:
2.1982B.06 POWERS OF THE BOARD.
2.20The board shall make recommendations to the commissioner as the commissioner
2.21requests or at the board's own initiative on:
2.22(1) rules with respect to each category of licensed real estate appraiser, the type of
2.23educational experience, appraisal experience, and equivalent experience that will meet
2.24the requirements of this chapter;
2.25(2) examination specifications for each category of licensed real estate appraiser,
2.26to assist in providing or obtaining appropriate examination questions and answers, and
2.27procedures for grading examinations;
2.28(3) rules with respect to each category of licensed real estate appraiser, the
2.29continuing education requirements for the renewal of licensing that will meet the
2.30requirements provided in this chapter;
2.31(4) periodic review of the standards for the development and communication of
2.32real estate appraisals provided in this chapter and rules explaining and interpreting the
2.33standards; and
3.1(5) other matters necessary in carrying out the provisions of this chapter.
3.2EFFECTIVE DATE.This section is effective August 1, 2010."
