1.7the secretary of state that are provided by a person whom the secretary of state determines
1.8is not eligible to vote is governed by section 201.161.

1.11    "Sec. 3. Minnesota Statutes 2010, section 201.121, subdivision 2, is amended to read:
1.12    Subd. 2. Notice of registration; challenges. The county auditor shall mail a notice
1.13indicating the individual's name, address, precinct and polling place to each registered
1.14voter. The notice must inform the voter that if eligible, the voter is now registered to
1.15vote, that it is a felony to vote if an individual is not eligible, and that the voter should
1.16immediately call the county auditor if the voter is not eligible or does not want to be
1.17registered to vote. The notice must contain a description of voter eligibility criteria. The
1.18notice must also inform the voter that the voter may contact the county auditor to correct
1.19the registration. The notice must provide the contact information for the county auditor.
1.20The notice shall indicate that it must be returned if it is not deliverable to the voter at the
1.21named address. Upon return of the notice by the postal service, the county auditor shall
1.22change the registrant's status to "challenged" in the statewide registration system. An
1.23individual challenged in accordance with this subdivision shall comply with the provisions
1.24of section 204C.12, before being allowed to vote.
1.25EFFECTIVE DATE.This section is effective August 1, 2015.

2.1    Sec. 4. Minnesota Statutes 2010, section 201.161, is amended to read:
2.2201.161 AUTOMATIC REGISTRATION OF DRIVER'S LICENSE,
2.3INSTRUCTION PERMIT, AND IDENTIFICATION CARD APPLICATIONS
2.4APPLICANTS.
2.5    Subdivision 1. Automatic registration. An individual who properly completes
2.6an application for a new or renewed Minnesota driver's license, instruction permit, or
2.7identification card, and who is eligible to vote under section 201.014, must be registered to
2.8vote as provided in this section, unless the applicant declines to be registered.
2.9    Subd. 2. Applications. The Department commissioner of public safety, in
2.10consultation with the secretary of state, shall change its the applications for an original,
2.11duplicate, or change of address driver's license, instruction permit, or identification card so
2.12that the forms may also serve as voter registration applications. The forms must contain
2.13spaces for all information collected by voter registration applications prescribed by the
2.14secretary of state and a box for the applicant to decline to be registered to vote. Applicants
2.15for driver's licenses or identification cards must be asked if they want to register to vote
2.16at the same time and that information must be transmitted at least weekly Unless the
2.17applicant has declined to be registered to vote or has provided an address other than the
2.18applicant's address of residence under section 5B.05 or 171.12, subdivision 7, paragraph
2.19(d), the commissioner shall transmit the information daily by electronic means to the
2.20secretary of state. Pursuant to the Help America Vote Act of 2002, Public Law 107-252,
2.21the computerized driver's license record containing the voter's name, address, date of
2.22birth, citizenship, driver's license number or state identification number, county, town, and
2.23city or town, and signature must be made available for access by the secretary of state and
2.24interaction with the statewide voter registration system.
2.25    Subd. 3. Registration. (a) The secretary of state shall determine whether the
2.26applicant is currently registered in the statewide voter registration system. For each
2.27currently registered voter whose name or address data is identical, the secretary of state
2.28shall update the voter's registration data in the statewide voter registration system. For
2.29each currently registered voter whose name or address data is not identical, the secretary
2.30of state shall transmit the registration daily by electronic means to the county auditor of
2.31the county where the voter resides.
2.32(b) If the applicant is not currently registered in the statewide voter registration
2.33system, the secretary of state shall determine whether the data indicate that the applicant
2.34is 18 years of age or older and a citizen of the United States and compare the voter
2.35registration information received from the commissioner of public safety with the
2.36information on wards, incompetents, and felons received from the state court administrator
3.1under sections 201.15 and 201.155, and with data received from the commissioner of
3.2corrections under section 201.157, to determine whether the applicant is ineligible to
3.3vote. If an applicant is less than 18 years of age, the secretary of state shall wait until the
3.4applicant has turned 18 years of age to determine whether the applicant is otherwise
3.5ineligible to vote. For each applicant the secretary of state has not found to be ineligible,
3.6the secretary of state shall transmit the registration daily by electronic means to the county
3.7auditor of the county where the voter resides.
3.8(c) Any data on applicants who the secretary of state determines are not eligible to
3.9vote are private data on individuals.
3.10    Subd. 4. Notice. Upon receipt of the registration, the county auditor shall process
3.11the registration and mail to the voter the notice of registration required by section 201.121,
3.12subdivision 2.
3.13    Subd. 5. Effective date. An application for registration that is dated during the 20
3.14days before an election in any jurisdiction within which the voter resides is not effective
3.15until the day after the election.
3.16EFFECTIVE DATE.This section is effective August 1, 2015.

3.17    Sec. 5. Minnesota Statutes 2010, section 204C.08, is amended by adding a subdivision
3.18to read:
3.19    Subd. 2b. Roster notice. A notice must be placed prominently by the roster to
3.20inform each voter that by signing the roster, the voter is swearing or affirming that the
3.21voter is eligible to vote, and that it is a felony for an individual to vote if the individual is
3.22not eligible. The notice must provide a description of eligibility criteria for voting.
3.23EFFECTIVE DATE.This section is effective August 1, 2015."
