1.3Page 6, after line 29, insert:

1.4    "Sec. 12. Minnesota Statutes 2010, section 161.38, subdivision 3, is amended to read:
1.5    Subd. 3. Frontage road. (a) The commissioner for and on behalf of the state
1.6may enter into agreements with municipalities for the construction, improvement, and
1.7maintenance of trunk highways within the limits of said municipalities, including but
1.8not limited to agreements for the construction and maintenance of frontage roads upon
1.9and along trunk highways within the limits of said municipalities. Such frontage roads
1.10may be constructed along the main-traveled lanes of the trunk highway, or they may
1.11be constructed a reasonable distance out from the limits of the right-of-way acquired
1.12for the main-traveled lanes if in the considered judgment of the commissioner such
1.13location is necessary to eliminate unreasonable circuity of local travel or to provide
1.14access to properties otherwise denied access to public highways by the establishment and
1.15construction of the trunk highway. Such frontage roads shall connect, at least at one
1.16terminal, either with the main lanes of the trunk highway or with another public highway.
1.17The municipalities are authorized to enter into such agreement with the commissioner for
1.18the performance and responsibility of the work upon such terms as may be agreed upon.
1.19Where a segment of a frontage road includes a ramp for a controlled access highway, the
1.20terminal of the frontage road is located 50 feet from the divergence between the ramp and
1.21the through street that forms the frontage road.
1.22(b) Notwithstanding section 160.18 and rules adopted under that section, authority to
1.23issue a permit to construct or alter a driveway giving access to a frontage road within a
1.24municipality belongs exclusively to the municipality in which the frontage road is located,
1.25subject to paragraph (c). A local road authority may approve access to a frontage road
1.26under this paragraph if the driveway affords reasonable access, and the access conforms to
1.27criteria specified in the Federal Highway Administration access management standards.
2.1A driveway affords reasonable access when (1) it is a first or second point of access
2.2from a parcel to the frontage road; and (2) its location from the nearest intersection is the
2.3greater of (i) 100 feet, or (ii) a distance equivalent to the minimum stopping sight distance
2.4between the intersection and the driveway. Driveway access on that segment of a ramp
2.5that is not a part of the frontage road under paragraph (a) is reasonable when it is located
2.6on the opposite side of the road from the ramp and appropriate measures exist to prevent
2.7traffic from crossing from the driveway to the ramp.
2.8(c) Nothing in paragraph (b) authorizes a municipality to authorize driveway access
2.9to a frontage road in which the driveway encroaches on, or otherwise extends across, any
2.10tract or parcel acquired by the Department of Transportation for access control purposes."

2.12Amend the title accordingly
