1.17    Sec. 17. Minnesota Statutes 2010, section 168.012, is amended by adding a subdivision
1.18to read:
1.19    Subd. 2d. Electric-assisted bicycles. Electric-assisted bicycles must not be taxed as
1.20motor vehicles using the public streets and highways, and are exempt from the provisions
1.21of this chapter."

2.26though equipped with two front or rear wheels. "Bicycle" does not include scooters,

2.28    Sec. 38. Minnesota Statutes 2010, section 169.011, subdivision 27, is amended to read:
2.29    Subd. 27. Electric-assisted bicycle. "Electric-assisted bicycle" means a motor
2.30vehicle bicycle with two or three wheels that:
2.31(1) has a saddle and fully operable pedals for human propulsion;
2.32(2) meets the requirements:
2.33(i) of federal motor vehicle safety standards for a motor-driven cycle in Code of
2.34Federal Regulations, title 49, sections 571.1 et seq.; or
3.1(ii) for bicycles under Code of Federal Regulations, title 16, part 1512, or successor
3.2requirements; and
3.3(3) has an electric motor that (i) has a power output of not more than 1,000 watts, (ii)
3.4is incapable of propelling the vehicle at a speed of more than 20 miles per hour, (iii) is
3.5incapable of further increasing the speed of the device when human power alone is used
3.6to propel the vehicle at a speed of more than 20 miles per hour, and (iv) disengages or
3.7ceases to function when the vehicle's brakes are applied.

3.8    Sec. 39. Minnesota Statutes 2010, section 169.011, subdivision 44, is amended to read:
3.9    Subd. 44. Motorcycle. "Motorcycle" means every motor vehicle having a seat or
3.10saddle for the use of the rider and designed to travel on not more than three wheels in
3.11contact with the ground, including motor scooters and bicycles with motor attached, other
3.12than those vehicles defined as. "Motorcycle" does not include (1) motorized bicycles

3.24    Subd. 4. Riding on roadway or shoulder rules. (a) Every person operating a
3.25bicycle upon a roadway shall ride as close as practicable to the right-hand curb or edge of
3.26the roadway except under any of the following situations:
3.27(1) when overtaking and passing another vehicle proceeding in the same direction;
3.28(2) when preparing for a left turn at an intersection or into a private road or driveway;
3.29(3) when reasonably necessary to avoid conditions, including fixed or moving
3.30objects, vehicles, pedestrians, animals, surface hazards, or narrow width lanes, that make
3.31it unsafe to continue along the right-hand curb or edge.
3.32(b) If a bicycle is traveling on a shoulder of a roadway, the bicycle shall travel in the
3.33same direction as adjacent vehicular traffic.
4.1(c) Persons riding bicycles upon a roadway or shoulder shall not ride more than two
4.2abreast and shall not impede the normal and reasonable movement of traffic and, on a
4.3laned roadway, shall ride within a single lane.
4.4(d) A person operating a bicycle upon a sidewalk, or across a roadway or shoulder
4.5on a crosswalk, shall yield the right-of-way to any pedestrian and shall give an audible
4.6signal when necessary before overtaking and passing any pedestrian. No person shall ride
4.7a bicycle upon a sidewalk within a business district unless permitted by local authorities.
4.8Local authorities may prohibit the operation of bicycles on any sidewalk or crosswalk
4.9under their jurisdiction.
4.10(e) An individual operating a bicycle or other vehicle on a bikeway shall leave a safe
4.11distance when overtaking a bicycle or individual proceeding in the same direction on the
4.12bikeway, and shall maintain clearance until safely past the overtaken bicycle or individual.
4.13(f) A person lawfully operating a bicycle on a sidewalk, or across a roadway or
4.14shoulder on a crosswalk, shall have all the rights and duties applicable to a pedestrian
4.15under the same circumstances.
4.16(g) A person may operate an electric-assisted bicycle on the shoulder of a roadway,
4.17on a bikeway, or on a bicycle trail, if not otherwise prohibited under section 85.015,
4.18subdivision 1d; 85.018, subdivision 2, paragraph (d); or 160.263, subdivision 2, paragraph
4.19(b), as applicable."

4.31    Sec. 45. Minnesota Statutes 2010, section 169.222, is amended by adding a subdivision
4.32to read:
4.33    Subd. 6b. Operator age. No person under the age of 15 shall operate an
4.34electric-assisted bicycle.

5.1    Sec. 46. Minnesota Statutes 2010, section 169.222, subdivision 7, is amended to read:
5.2    Subd. 7. Sale with reflectors and other equipment. No person shall sell or offer for
5.3sale any new bicycle unless it is equipped with reflectors and other equipment as required
5.4by subdivision 6, clauses (a) and paragraphs (b) and (e) and by the applicable regulations
5.5for new bicycles prescribed by the United States Consumer Product Safety Commission.

5.6    Sec. 47. Minnesota Statutes 2010, section 169.223, subdivision 1, is amended to read:
5.7    Subdivision 1. Safety equipment; parking. Except as otherwise provided in this
5.8section, Section 169.974 relating to motorcycles is applicable to motorized bicycles,
5.9except as otherwise provided in this section and except that:
5.10(1) protective headgear includes headgear that meets the American National
5.11Standard for Protective Headgear for Bicyclists, ANSI Z90.4-1984, approved by the
5.12American National Standards Institute, Inc. standards under Code of Federal Regulations,
5.13title 16, part 1203, or successor requirements;
5.14(2) a motorized bicycle equipped with a headlight and taillight meeting the
5.15requirements of lighting for motorcycles may be operated during nighttime hours;
5.16(3) except as provided in clause (5), protective headgear is not required for operators
5.1718 years of age or older; and
5.18(4) the provisions of section 169.222, subdivision 9, governing the parking of
5.19bicycles apply to motorized bicycles;.
5.20(5) the operator of an electric-assisted bicycle must wear properly fitted and
5.21fastened headgear that meets the American National Standard for Protective Headgear for
5.22Bicyclists, ANSI Z90.4-1984, approved by the American National Standards Institute,
5.23Inc., when operating the electric-assisted bicycle on a street or highway; and
5.24(6) eye protection devices are not required for operators of electric-assisted bicycles.

5.25    Sec. 48. Minnesota Statutes 2010, section 169.223, subdivision 5, is amended to read:
5.26    Subd. 5. Other operation requirements and prohibitions. (a) A person operating
5.27a motorized bicycle on a roadway shall ride as close as practicable to the right-hand curb
5.28or edge of the roadway except in one of the following situations:
5.29(1) when overtaking and passing another vehicle proceeding in the same direction;
5.30(2) when preparing for a left turn at an intersection or into a private road or
5.31driveway; or
5.32(3) when reasonably necessary to avoid conditions, including fixed or moving
5.33objects, vehicles, pedestrians, animals, surface hazards, or narrow width lanes, that make
5.34it unsafe to continue along the right-hand curb or edge.
6.1(b) Persons operating motorized bicycles on a roadway may not ride more than two
6.2abreast and may not impede the normal and reasonable movement of traffic. On a laned
6.3roadway, a person operating a motorized bicycle shall ride within a single lane.
6.4(c) This section does not permit the operation of a motorized bicycle on a bicycle
6.5path or bicycle lane that is reserved for the exclusive use of nonmotorized traffic.
6.6(d) Subject to the provisions of section 160.263, subdivision 3, a person may operate
6.7an electric-assisted bicycle on a bicycle lane. A person may operate an electric-assisted
6.8bicycle on the shoulder of a roadway if the electric-assisted bicycle is traveling in the same
6.9direction as the adjacent vehicular traffic."
