1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. Minnesota Statutes 2010, section 473.388, subdivision 4, is amended to
1.4read:
1.5    Subd. 4. Financial assistance. (a) The council must grant the requested financial
1.6assistance if it determines that the proposed service is intended to replace the service to
1.7the applying city or town or combination thereof by the council and that the proposed
1.8service will meet the needs of the applicant at least as efficiently and effectively as the
1.9existing service.
1.10    (b) The minimum amount of assistance which the council must provide to a system
1.11under this section may not be less than the sum of the amounts determined calculated
1.12for each municipality comprising the system as follows: of the replacement service
1.13municipalities.
1.14(c) The minimum amount of financial assistance for each replacement service
1.15municipality is calculated as:
1.16    (1) an amount equal to 6.25 percent of the total state revenues generated from the
1.17taxes imposed under chapter 297B for the current fiscal year; times
1.18(2) the ratio of (i) the transit operating assistance grants received under this
1.19subdivision by the municipality in calendar year 2001 or the tax revenues for transit
1.20services levied by the municipality for taxes payable in 2001, including that portion of the
1.21levy derived from the areawide pool under section 473F.08, subdivision 3, clause (a), plus
1.22the portion of the municipality's aid under section 273.1398, subdivision 2, attributable
1.23to the transit levy; times(2) the ratio of (i) an amount equal to 3.74 percent of the state
1.24revenues generated from the taxes imposed under chapter 297B for the current fiscal
1.25year to (ii) the total transit operating assistance grants received under this subdivision
1.26in calendar year 2001 or the tax revenues for transit services levied by all replacement
1.27service municipalities under this section for taxes payable in 2001, including that portion
2.1of the levy derived from the areawide pool under section 473F.08, subdivision 3, clause
2.2(a), plus the portion of homestead and agricultural credit aid under section 273.1398,
2.3subdivision 2
, attributable to nondebt transit levies,; times
2.4    (3) the ratio of (i) the municipality's total taxable market value for taxes payable
2.5in 2006 divided by the municipality's total taxable market value for taxes payable in
2.62001, to (ii) the total taxable market value of all property located in replacement service
2.7municipalities for taxes payable in 2006 divided by the total taxable market value of all
2.8property located in replacement service municipalities for taxes payable in 2001.
2.9    (c) (d) The council shall pay the amount to be provided to the recipient from the
2.10funds the council receives in the metropolitan area transit account under section 16A.88.
2.11EFFECTIVE DATE.This section is effective (1) July 1, 2013; or (2) July 1, 2012,
2.12if a bill is enacted in the 2012 session that eliminates for fiscal year 2013 the allocation of
2.13financial assistance to transit providers required under Laws 2011, first special session,
2.14chapter 3, article 1, section 4."
