1.3Page 1, after line 11, insert:

1.4    "Sec. 2. [216B.246] STATES' RIGHTS: NUCLEAR INSURANCE.
1.5    Subdivision 1. Legislative finding. The legislature finds that the Tenth Amendment
1.6to the Constitution of the United States guarantees to the states or its citizens all powers
1.7not delegated to the federal government elsewhere in the Constitution and reserves to this
1.8state and the citizens of this state certain powers as they were understood at the time this
1.9state was admitted to statehood.
1.10    Subd. 2. Legislative declaration. The legislature declares that this state has the
1.11right to refuse to abide by any federal mandate, law, or regulation that jeopardizes the
1.12private property rights of Minnesota residents.
1.13    Subd. 3. Federal nuclear insurance indemnity; waiver. An entity licensed
1.14by the federal Nuclear Regulatory Commission to operate a nuclear powered electric
1.15generating plant constructed in this state after the effective date of this act may not
1.16operate the plant unless the licensee has certified to the Nuclear Regulatory Commission
1.17that the indemnification and limitation of liability conferred to the licensee under the
1.18Price-Anderson Nuclear Industries Indemnity Act, United States Code, title 42, section
1.192210, is waived, and that the licensee agrees to pay any and all damages to health,
1.20property, and the environment resulting from the release of radioactivity from the plant
1.21through liability insurance available from private sources and utility revenues and
1.22assets, excluding any revenues from Minnesota ratepayers specifically approved by the
1.23commission to pay for damages resulting from the release of radioactivity from the plant."
1.24Renumber the sections in sequence and correct the internal references
1.25Amend the title accordingly
