1.3    "Sec. 41. [174.187] MADE IN MINNESOTA SOLAR INSTALLATIONS.
1.4    Subdivision 1. Definition. (a) For the purposes of this section, the following terms
1.5have the meanings given.
1.6(b) "Made in Minnesota" means the manufacture in this state of solar photovoltaic
1.7modules:
1.8(1) at a manufacturing facility located in Minnesota that is registered and authorized
1.9to manufacture and apply the UL 1703 certification mark to solar photovoltaic modules by
1.10Underwriters Laboratory (UL), CSA International, Intertek, or an equivalent UL-approved
1.11independent certification agency;
1.12(2) that bear UL 1703 certification marks from UL, CSA International, Intertek, or
1.13an equivalent UL-approved independent certification agency, which must be physically
1.14applied to the modules at a manufacturing facility described in clause (1); and
1.15(3) that are manufactured in Minnesota:
1.16(i) via manufacturing processes that must include tabbing, stringing, and lamination;
1.17or
1.18(ii) by interconnecting low-voltage direct current photovoltaic elements that produce
1.19the final useful photovoltaic output of the modules.
1.20(c) "Solar photovoltaic module" has the meaning given in section 116C.7791,
1.21subdivision 1, paragraph (e).
1.22    Subd. 2. Made in Minnesota solar energy system requirement. Notwithstanding
1.23any other law to the contrary, if the commissioner engages in any project for the
1.24construction, improvement, maintenance, or repair of any building, highway, road, bridge,
1.25or land owned or controlled by the department and the construction, improvement,
1.26maintenance, or repair involves installation of one or more solar photovoltaic modules, the
2.1commissioner must ensure that the solar photovoltaic modules purchased and installed are
2.2made in Minnesota as defined in subdivision 1, paragraph (b).
2.3    Subd. 3. Application. Subdivision 2 does not apply if, as a condition of the receipt
2.4of federal financial assistance for a specific project, the commissioner is required to use a
2.5procurement method that might result in the award of a contract to a manufacturer that does
2.6not meet the "Made in Minnesota" criteria established in subdivision 1, paragraph (b)."
