St. Paul, MN - Today, the Minnesota House passed the Commerce Conference Committee Report - HF 4188. Included in the bill is legislation authored by Rep. Alex Falconer (DFL - Eden Prairie) prohibiting a health plan from using AI to deny a policy holder’s prior authorization.
“There is already so much about our health insurance system that doesn’t work for Minnesotans, the last thing we should be doing is removing the human element entirely,” said Rep. Falconer. “Medical decisions should be made by medical professionals, not profit-driven AI algorithms.”
For-profit health insurance companies have been caught issuing denials through AI with a documented 90% error rate, knowing the vast majority of people don’t or can’t appeal the decision. The use of AI has gone against the advice of medical providers, delaying or denying medication, and prematurely ending hospital stays.
While the legislation prohibits AI from being used to deny prior authorization, its use is allowed for approving prior authorization.
