MINUTES


Representative Tim Wilkin, Chair of the Commerce & Financial Institutions Committee, called the tenth meeting to order at 12:35 p.m. on Tuesday, February 22, 2005, in Room 200 of the State Office Building.

The Clerk noted the roll.

A quorum was present.

Rep. Rukavina moved that the minutes from the meeting of February 16, 2005 be approved.

The motion prevailed.


HF536 (Marquart) Prevailing wage requirements modified.

Rep. Wilkin moved that HF536 be recommended to pass and be re-referred to the Committee on Jobs and Economic Opportunity Policy and Finance.

Rep. Marquart presented HF536.

Testifying on behalf of HF536:

Mark Sellin & Scott Sorenson, Sellin Bros.
Dave Semarad, CEO, General Associated Contractors.

Rep. Rukavina moved to incorporate the A05-0082 amendment to HF536.

Rep. Wilkin ruled the amendment out of order under the 24-hour rule.

Rep. Rukavina appealed the ruling of the chair and requested a roll-call vote.

Rep. Rukavina withdrew the A05-0082 amendment.


Testifying against HF536:

Dick Anfang, Minnesota Building & Trades Council.

Rep. Wilkin renewed his motion that HF536 be recommended to pass and be re-referred to the Committee on Jobs and Economic Opportunity Policy and Finance.

Rep. Howes requested a roll-call vote.

The following eleven members voted in favor of the motion:

DAVIDS, GAZELKA, GUNTHER, HAMILTON, KOHLS, PEPPIN, SEVERSON, SIMPSON, SODERSTROM, WILKIN, ZELLERS.

The following fourteen members voted against the motion:

ATKINS, CLARK, FRITZ, GOODWIN, HOWES, JAROS, LIEBLING, LOEFFLER, MOE, MULLERY, POWELL, RUKAVINA, SAILER, SERTICH.

The following member was absent:

VANDEVEER.

The motion did not prevail (11-14).


HF938 (Garofalo) Real estate document pilot project continuation, extension, validation, and Web posting provided.

Rep. Powell moved that HF938 be recommended to pass and be re-referred to the Committee on Governmental Operations and Veterans Affairs.

Rep. Garofalo presented HF938.

Testifying on behalf of HF938:

Joel Beckman, Director, Property Records, Dakota County.

HF938 was laid on the table for further discussion.
