Representative Kathy Tingelstad, Chair of the Governmental Operations and Veterans Affairs Committee, called the thirteenth meeting to order at 10:18 am on Wednesday, February 16, 2005, in Room 5 of the State Office Building.

The Clerk noted the roll.

10:18:14 AM Representative Dempsey moved the approval of the minutes of Thursday, February 10, 2005. THE MOTION PREVAILED.

HF871 (Seifert) relating to state government; authorizing participation of day training and habilitation services providers in state cooperative purchasing agreements; including certain rehabilitation facilities, extended employment providers, and day training and habilitation services providers in the state agency acquisition process; amending Minnesota Statutes 2004, sections 16C.10, subdivision 5; 16C.15; 471.59, subdivision 1.

10:19:28 AM Representative Seifert moved that HF871 be recommended to pass and be re-referred to the Consent Calendar.

Representative Seifert moved the H0871A2 Amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

10:23:54 AM Representative Seifert renewed his motion that HF871 be recommended to pass as amended and be re-referred to the Consent Calendar. THE MOTION PREVAILED.

HF801 (Dempsey) a resolution memorializing the Congress of the United States to propose an amendment to the United States Constitution, for ratification by the states, specifying that Congress and the states shall have the power to prohibit the physical desecration of the flag of the United States.

10:24:38 AM Representative Dempsey moved that HF801 be recommended to pass and be re-referred to the Committee on Rules.

HF241 (Vandeveer) relating to public employment; providing that a public employer or a contractor with a public employer may not forbid an employee from wearing an American flag patch or pin; proposing coding for new law in Minnesota Statutes, chapter 15.

10:44:12 AM Representative Tingelstad moved that HF241 be recommended to pass and be re-referred to the Committee on Local Government.

10:57:50 AM Representative Tingelstad welcomed visitors from the Minnesota Valley Lutheran School, New Ulm, MN, who were participants in the Capitol Historic Site’s “Voice of the People: Your Role in Minnesota Government” tour and educational program.

11:07:49 AM Representative Tingelstad withdrew her oral amendment.

11:08:32 AM Rep. Kahn moved the oral amendment and requested a roll call vote on the oral amendment.

11:12:01 AM Representative Seifert moved to amend HF241 as follows:
Page 1, delete lines 17-21.
Page 1, line 22, delete "(c)" and insert "(b)".
Page 2, line 2, delete "(d)" and insert "(c)".

Representative Seifert moved to amend the title of HF241 as follows:
Page 1, line 3, delete “or a contractor with a public employer.”

11:14:17 AM Representative Seifert renewed his oral amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

11:22:44 AM Representative Tingelstad renewed her motion to pass HF241 as amended and be re-referred to the Committee on Local Government. THE MOTION PREVAILED AND THE BILL WAS PASSED.
