MINUTES


Representative Morrie Lanning, Vice-Chair of the Local Government Committee, called the thirty-eighth meeting to order at 9:17 A.M. on Friday, March 17, 2006, in Room 200 of the State Office Building.

The clerk noted the roll.

HF2946 (Howes) County office appointment and consolidation provided subject to notice, hearing, and reverse referendum.

CORNISH, Tony moved to recommend HF2946 pass.

At the request of the Chief Author, CORNISH, Tony moved to recommend HF2946 be amended as follows:

The Cornish Motion Prevailed.

Representative Larry Howes provided testimony on and responded to the Committee’s questions regarding HF2946 as amended.

Representative Olson assumed the Chair.

The following provided testimony on and responded to the Committee’s questions regarding HF2946 as amended:

Jim Demgen (878 Birch Ln, East Gull Lake, MN, 56401), Chair of the County Board of Commissioners, and Robert Yochum, County Administrator, Cass County, 303 Minnesota Av W, Walker, MN, 56484.

There being no further testimony, pro or con, the question reoccurred on the Cornish Motion as amended to recommend HF2946 be amended, and when so amended be recommended to pass. THE MOTION PREVAILED.


HF3454 (Ruth) County recorder document standards, registration fees, and provisions modified.

LANNING, Morrie to recommend HF3454 pass.

The following provided testimony on and responded to the Committee’s questions regarding HF3454:

Representative Connie Ruth; Kay Wrucke (Martin County Recorder, 201 Lake Av, Fairmont, MN, 56031), Lynn Ette Schrupp (McLeod County Recorder, 2389 Hennepin Av N, Glencoe, MN, 55336), and Luci Botzek, MN Association of County Officers Administrator, on behalf of the MN County Recorders’ Association. Suite 414, 26 Exchange Street E, St. Paul, MN 55101.

At the request of the Chief Author, LANNING, Morrie moved to recommend HF3454 be amended as follows:

The Lanning Motion to amend Prevailed

The Chair called Representative Lanning to the Chair.

There being no further testimony, pro or con, the question reoccurred on the Lanning Motion as amended to recommend HF3454 be amended, and when so amended be recommended to pass. THE MOTION PREVAILED.

Representative Olson resumed the Chair.

HF3140 (Haws) Financial statement publication requirements of counties modified.

MARQUART, Paul moved to recommend HF3140 pass and be re-referred to the Committee on Civil Law and Elections.

The following provided testimony on and responded to the Committee’s questions regarding HF3140:

Representative Larry Haws; and Randy Schreifels, Stearns County Auditor-Treasurer, Rm 148, 705 Courthouse Square, St. Cloud, MN, 56303-4781.

ANDERSON, Bruce moved to recommend HF3140 be amended as follows:

Page 1, line 12 after “site” insert “, if it exists”

Curtis Yoakum, Policy Analyst, Association of Minnesota Counties, 125 Charles Av, St. Paul, MN, 55103, provided testimony on and responded to the Committee’s questions regarding HF3140 and the Anderson Motion to amend.

The question reoccurred on the Anderson Motion. The Motion Prevailed.

Mark Anfinson, Attorney, MN Newspaper Association, Suite 1120, 12 Sixth St S, Minneapolis, MN, 55402, provided testimony on and responded to the Committee’s questions regarding the Marquart Motion as amended.

There being no further testimony, pro or con, the question reoccurred on the Marquart Motion as amended to recommend HF3140 be amended, and when so amended be recommended to pass. THE MOTION PREVAILED.



HF3515 (Peppin) Preventive health services program operation by cities authorized.

OLSON, Mark moved to recommend HF3515 pass and be placed on the Consent Calendar.

The following provided testimony on and responded to the Committee’s questions regarding HF3515:

Representative Joyce Peppin; and Anne Finn, Assistant Intergovernmental Relations Director, League of Minnesota Cities, 145 University Av W, St. Paul, MN, 55103-2044.

There being no further testimony, pro or con, the question reoccurred on the Olson Motion. THE MOTION PREVAILED.


HF2965 (Vandeveer) Local government requirements for use of nonconforming lots limited.

OLSON, Mark moved to recommend HF2965 pass.

At the request of the Chief Author, OLSON, Mark moved to recommend HF2965 be amended as follows:

The Olson Motion to amend Prevailed.

At the request of the Chief Author and without objection, HF2965 and the Olson Motion as amended were laid on the table.


ANDERSON, Bruce moved to reconsider the Olson Motion as amended, which was considered March 13, 2006 and did not prevail, to recommend HF2867 be amended and when so amended be recommended to pass.

Without objection the Anderson Motion to reconsider was postponed to March 20, 2006, to be listed on the agenda for that meeting.


Without objection the meeting was adjourned at 11:00 AM.
