Representative Jim Knoblach, Chair, called the thirty-seventh meeting to order at 8:42 a.m. on Wednesday, April 5, 2006 in Room 200 of the State Office Building.

The Clerk noted the roll.

Representative Knoblach called the meeting to order at 8:42 a.m. A quorum was present.

Representative Erhardt moved that the minutes of April 4, 2006 be approved. THE MOTION PREVAILED.

HF263 Abrams (2nd engrossment) University of Minnesota football stadium state support process provided, Dakota County land transfer to University of Minnesota provided, and money appropriated.

Representative Abrams moved that HF263, second engrossment, be recommended to pass and be moved to the General Register.

Representative Abrams, Representative Solberg, Lisa Uell, University of Minnesota, Larson, General Council, University of Minnesota, Charles Muskiplat, Vice President of Agricultural Policy, University of Minnesota, and Mark Holsten, Deputy Commissioner, MN. Department of Natural Resources testified on HF263.

Representative Knoblach moved the H263A15 amendment. THE AMENDMENT WAS ADOPTED.

Representative Kelliher moved the H263A13 amendment. THE AMENDMENT WAS ADOPTED.

Representative Abrams moved the H263A12 amendment.

Representative Wagenius moved to orally amend the H263A12 amendment by: L. 1.13 delete: “or adjacent to,” L.1.14 after “there to” add, “The University shall promptly endeavor to resolve its claims against the federal government with respect to environmental contamination that occurred prior to the time the University took title to the University land” THE ORAL AMENDMENT WAS INCORPORATED.

Representative Abrams moved that the H263A12 amendment, as incorporated, be adopted. THE AMENDMENT WAS ADOPTED.

Representative Holberg moved to orally amend HF263 by: delete, section one, P.1, L1.8 thru, L., 1.25. THE ORAL AMENDMENT WAS ADOPTED.

Representative Knoblach moved the H0263DE1 amendment,

Representative Knoblach moved to orally amend the DE1 amendment by: P.2, L.2.15 change $141,000,000 to $149,000,000, L., 2.20, change $7,000.000 to $7.400, 000, P.2, L, 2.21 change $94,000,000 to $99,000,000, change $7,000,000 to $7,400,000.

A roll call was requested on the H0263DE1 amendment by Representative McNamara.

Representative Knoblach withdrew the H0263DE1 amendment.

Representative Klinzing moved to re-refer the HF263 to the Environment Committee.

Representative Solberg requested a roll call vote on Representative Klinzing’s motion to re-refer HF263 to Environment Committee. The results were as follows.

Representative Vandaveer moved the H0263A14 amendment and requested a roll call vote. The results were as follows:

On a vote of 8 AYES and 21 NAYS THE AMENDMENT WAS NOT ADOPTED.

Representative Solberg moved the A17 amendment. THE AMENDMENT WAS ADOPTED.

Representative Abrams moved that HF263, 2nd engrossment, as amended, be recommended to pass. THE MOTION PREVAILED.

The meeting was recessed at 10:52 a.m.

The meeting was reconvened at 12:25 p.m.

KN-RES-7-1 Knoblach A resolution setting budget targets.

Representative Knoblach moved the KN-RES-7-1 Resolution.

Representative Knoblach and Joan Fabian, Commissioner, Minnesota Department of corrections testified on the KN-RES-7-1 Resolution.

Representative Knoblach moved to orally amend the KN-RES-7-1 Resolution by: P. 1, L., 1.11 change $72,250,000 to $75, 250,000. THE ORAL AMENDMENT WAS INCORPORATED.

Representative Knoblach moved that the KN-RES-7-1 Resolution as incorporated be recommended to pass. THE MOTION PREVAILED.

HF3002 Emmer Balance billing prohibited by health care providers and certain no-fault automobile insurance medical claims, and health care providers made the party at interest in certain no-fault arbitrations.

Representative Knoblach moved that HF3002 be recommended to pass and be sent to the General Register.

Representative Emmer testified on HF3002.

Representative Knoblach moved to orally amend HF3002 by: P. L. change 2005 to 2006. THE ORAL AMENDMENT WAS INCORPORATED.

Representative Rukavina moved to table HF3002. On a division of 11 AYES and 13 NAYS THE MOTION DID NOT PREVAIL.

Representative Knoblach moved that HF3002, as incorporated, be recommended to pass. THE MOTION PREVAILED.

The meeting was adjourned at 2:47 p.m.
