MINUTES


Representative Carlos Mariani, Chair of the E-12 Education Committee, unofficially called the twenty-seventh meeting to order at 8:05 AM on Thursday, March 6, 2008, in the Basement Hearing Room of the State Office Building.

The Committee Legislative Assistant noted the roll:

A quorum was not present.

HF 3596 (Faust) - A bill for an act relating to education; prohibiting the commissioner of education from enforcing unadopted rules; amending Minnesota Statutes 2006, section 127A.05.

Rep. Faust presented HF 3596.

Testifying on behalf of HF 3596 were:

Ms. Elizabeth Lodge Rogers, St. Cloud Area School District
Ms. Cecilia Dodge, St. Paul Public Schools

Chair Mariani officially called the hearing to order at 8:10 AM. A quorum was present.

Rep. Mariani moved that HF 3596 to be recommended to pass and re-referred to the Committee Government Operations, Reform, Technology, and Elections

Questions and discussion followed.

Testifying to the Minnesota Department of Education's concerns about HF 3596 was:

Commissioner Alice Seagren, Minnesota Department of Education.

Clarifying special education Individual Education Plan (IEP) rules was:
Ms. Amy Roberts, Compliance and Assistance Director, Minnesota Department of Education

Mariani renewed his motion that HF 3596 be recommended to pass and referred to the committee on Government Operations, Reform, Technology, and Elections. THE MOTION PREVAILED.

Due to time restraints, the Chair asked to hear testimony on HF 3733, which will be moved for approval at a later meeting.

Rep. S. Peterson gave a brief overview of HF 3733:

Ms. Kate Schmidt, teacher, ISD 196 (Rosemount-Apple Valley-Eagan)

HF 3621 (Hilstrom), - A bill for an act relating to education; extending the special education task force to allow it to complete its study of state special education rules; repealing sections identified by this task force.

Chair Mariani moved that HF 3621 be recommended to pass and placed on the General Register.

Chair Mariani moved the H3621A1 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Hilstrom presented HF 3621, as amended.

Testifying on behalf of HF 3621, as amended, were:

Chair Mariani renewed his motion that HF 3621, as amended, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.
