Representative Carlson, Chair of the Finance Committee, called the meeting to order at
8:12 A.M. on Thursday, May 10, 2007, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Rep. Mahoney presented, HF1208, Second Committee Engrossment (Mahoney)
Construction code and licensing provisions modified, penalties and enforcement
provided, statutes recodified, and money appropriated.

Rep. Finstad moved approval of the minutes of Wednesday, May 9, 2007. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Chair Carlson moved adoption of the Higher Education and Workforce Development
Finance Division Report for HF1208, Second Committee Engrossment. (See attached
language at http://wdoc.house.leg.state.mn.us/leg/LS85/CEH1208.2.pdf). THE
MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Mahoney moved that HF1208, Second Committee Engrossment, be recommended
to pass and re-referred to the Committee on Ways and Means.

Rep. Mahoney moved to amend HF1208, Second Committee Engrossment. (See
attached amendment A07-0925). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

John Schultz, Assistant Director, Minnesota Department of Labor and Industry responded to questions regarding HF1208, Second Committee Engrossment, as amended.

Rep. Seifert moved to amend HF1208, Second Committee Engrossment, as amended, as follows:

Pages 94-96, delete Section 6 of Article 6

Tom Joachim, Assistant Commissioner, Minnesota Department of Labor and Industry, responded to questions regarding the proposed oral amendment to HF1208, Second Committee Engrossment, as amended.

Rep. Seifert withdrew the proposed oral amendment.

Rep. Seifert moved to amend HF1208, Second Committee Engrossment, as amended, as follows:

Page 98, delete Section 9

Nancy J. Leppink, General Counsel, Minnesota Department of Labor and Industry responded to questions regarding the proposed oral amendment to HF1208, Second Committee Engrossment, as amended.

Rep. Westrom requested a roll call on the motion.

Voting Aye: Anderson, B., Cornish, Erhardt, Finstad, Garofalo, Hackbarth, Kohls, Peppin, Rukavina, Seifert, Severson, Solberg, Sviggum, Westrom

Voting Nay: Carlson, Hausman, Hilty, Huntley, Jaros, Juhnke, Lieder, Mahoney, Paymar, Poppe, Sailer, Simon, Thissen, Walker

There were 14 Ayes and 14 Nays. THE MOTION FAILED. THE AMENDMENT WAS NOT ADOPTED.

Rep. Mahoney moved to amend HF1208, Second Committee Engrossment, as amended, as follows:

Page 193, line 28, after "2009" insert "and each year thereafter"

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Mahoney renewed the motion that HF1208, Second Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Seifert requested a roll call on the motion.

THE MOTION PREVAILED.

Rep. Ozment presented HF2293 (Ozment) Claims against the state settlement provided relating to corrections, and money appropriated. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/HF2293.0.pdf).

Chair Carlson moved that HF2293 be recommended to pass and be re-referred to the
Committee on Ways and Means.

Chair Carlson moved to amend HF2293. (See attached amendment A07-0949). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Craig Lindeke, Revisor of Statutes Office, responded to questions regarding HF2293, as amended. Thank yous and congratulations were extended to Mr. Lindeke upon his upcoming retirement after 30 years of service with the Minnesota Legislature.

Chair Carlson renewed the motion that HF2293, as amended, be recommended to pass and be
re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

The following Finance Committee Bills were referred by memo on Wednesday, May 9, 2007.

To the Division on Education Finance and Economic Competitiveness.
HF2475 (Greiling) School district capital facilities bond repayment time period extended.


To the Division on Minnesota Heritage Finance.
HF2285 (Sertich) Natural resource and cultural heritage dedicated funding provided through increased sales tax revenue, funds established, Natural Heritage Enhancement Council created, and constitutional amendment proposed.

To the Division on State Government Finance.
HF2472 (Loeffler) Capitol complex renovation design funding provided, bonds issued, and money appropriated.

To the Division on Transportation Finance and Policy.
HF2474 (Jaros) Lake Superior Mississippi Railroad scenic railway improvements funding provided, and money appropriated.

The meeting was adjourned at 9:32 A.M.
