MINUTES


Representative Kahn, Chair of the Division, called the meeting to order at 1:15 P.M. on March 26, 2007 in Room 300 North of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was not present.

Chair Kahn moved that HF 1309, HF 376 and HF 1155 be heard and laid over for possible inclusion in the Omnibus State Government Finance bill.

HF 1309 (Hilstrom) - A bill for an act relating to state government; defining political subdivision for the purposes of the chapter governing the state auditor; applying provisions for the state auditor to all political subdivisions.

Representative Hilstrom and State Auditor Rebecca Otto testified in support of HF 1309.

HF 376 (Paulsen) - State contracts web site with a searchable database required, and money appropriated.

Representative Paulsen testified in support of HF 376

HF 1155 (Madore) - Statewide self-advocacy network project established relating to intellectual and developmental disabilities, and money appropriated.

Representative Madore testified in support of HF 1155. Also testifying in support were Rick Cardenas, Co-Director and Gloria Steinbring, Board Member, both of Advocating Change Together.

A quorum was present at 1:26 P.M.

Chair Kahn renewed her motion that HF 376 be laid over for possible inclusion in the Omnibus State Government Finance bill.

Representative Zellers moved that the H0376-A1 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn renewed her motion that HF 376, as amended, be laid over for possible inclusion in the Omnibus State Government Finance bill.

HF 1598 (Lillie) First Engrossment - Labor agreements and compensation plans ratified for the Minnesota Law Enforcement Association, the Minnesota Nurses Association, and the Office of Higher Education.

Vice-Chair Ward moved that HF 1598 be heard and recommended to pass and re-referred to Finance Committee.

Representative Lillie and Greg Hubinger, Director, Legislative Coordinating Commission, testified in support of HF 1598.

Vice-Chair Ward renewed his motion that HF 1598 be recommended to pass and re-referred to Finance Committee. THE MOTION PREVAILED.

HF 176 (Thissen) First Engrossment - Electronic documents study and report required.

Representative Hortman moved that HF 176 be heard laid over for possible inclusion in the Omnibus State Government Finance bill.

Representative Thissen testified in support of HF 176.

Representative Hortman moved an oral amendment to HF 176 as follows:
Page 1, line 1.9 after "choice"
delete "."
insert "and"

Page 1, line 1.9 after "interoperability"
insert "."

Page 1, line 1.10 delete "and vendor neutrality."

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Hortman renewed her motion that HF 176, as amended, be laid over for possible inclusion in the Omnibus State Government Finance bill.

SF 538 (Kubly)/HF 1034 (Peterson) First Engrossment - Heating and cooling policy for state building projects established.

Chair Kahn moved that SF 538 be recommended to pass and re-referred to Finance Committee.

Chair Kahn moved to amend SF 538 by substituting the language in HF 1034. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Peterson and State Architect Heidi Myers, Department of Administration testified in support of SF 538.

Chair Kahn renewed her motion that SF 538 be passed, as amended, and re-referred to the Finance Committee. THE MOTION PREVAILED.

HF 768 (Kalin) First Engrossment - Absentee ballot voting requirements and procedures changed.

Vice-Chair Ward moved that HF 768 be heard and laid over for possible inclusion in the Omnibus State Government Finance bill.

Representative Kalin and Beth Fraser, Director of Governmental Affairs, Secretary of State's Office, testified in support of HF 768.

HF 333 (Lillie) - State employees compensated for time they were not able to work due to the 2005 partial government shutdown.

Chair Kahn moved that HF 333 be heard and laid over for possible inclusion in the Omnibus State Government Finance bill.

Representative Lillie testified in support of HF 333.

Paul Larson, Deputy Commissioner, Department of Employee Relations, testified in opposition to HF 333.

HF 1546 (Simon) First Engrossment - Driver's license and identification card applicants automatic voter registration provided, and money appropriated.

Chair Kahn moved that HF 1546 heard and laid over for possible inclusion in the Omnibus State Government Finance bill.

Representative Simon and Mark Ritchie, Secretary of State, testified in support of HF 1546.

HF 1547 (Simon) - State elections campaign fund appropriation increased.

Chair Kahn moved that HF 1547 heard and laid over for possible inclusion in the Omnibus State Government Finance bill.

Representative Simon testified in support of HF 1547.

HF 1608 (Bigham) First Engrossment - Secretary of State; registrations, filings, and dissolutions of certain entities regulated; fees provided; foreign limited partnership name changes regulated; and notaries public regulation provided.

Representative Bigham moved that HF 1608 be heard and laid over for possible inclusion in the Omnibus State Government Finance bill.

Representative Bigham and Bert Black, Legal Advisor, Secretary of State's Office, testified in support of HF 1608.

HF 2066 (Kahn) - Building replacement fund established.

Chair Kahn moved that HF 2066 heard and laid over for possible inclusion in the Omnibus State Government Finance bill

Chair Kahn and Kari Suchy, Business Operations Manager, Department of Administration, testified in support of HF 2066.

HF 1638 (Kahn) - Grants management process, governance, and structure established; and money appropriated.

Chair Kahn moved that HF 1638 heard and laid over for possible inclusion in the Omnibus State Government Finance bill

Chair Kahn and Commissioner Dana Badgerow, Department of Administration, testified in support of HF 1638.

HF 219 (Walker) First Engrossment - Personal sick leave benefits extended to include care for specified relatives.

Chair Kahn moved that HF 219 heard and laid over for possible inclusion in the Omnibus State Government Finance bill.


Representative Walker and Iris C. Freeman, Policy Advisor, Alzheimer's Association, testified in support of HF 219.

Paul Larson, Deputy Commissioner, Department of Employee Relations, and Anne Finn, Lobbyist for League of Minnesota Cities, testified in opposition to HF 219.

HF 2117 (Berns) - Administration Department funding provided for promotion of document imaging work to be done by persons with developmental disabilities, and money appropriated.

Chair Kahn moved that HF 2117 heard and laid over for possible inclusion in the Omnibus State Government Finance bill.

Representative Berns and Commissioner Dana Badgerow, Department of Administration, testified in support of HF 2117.

HF 446 (Kahn) Second Engrossment - Outdoor light pollution restricted.

Chair Kahn moved that HF 446 heard and laid over for possible inclusion in the Omnibus State Government Finance bill.

Chair Kahn moved that the H0446-A4 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved that the H0446-A5 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn renewed her motion that HF 446, as amended, be laid over for possible inclusion in the Omnibus State Government Finance bill.

HF 150 (DeLaForest) - State agency fee moratorium imposed.

Representative DeLaForest moved that HF 150 be laid over for future consideration.

HF 1160 (Hilstrom) First Engrossment - Local governments and school districts postemployment benefits trusts authorized, and money appropriated.

Representative Bigham moved that HF 1160 be heard and laid over for possible inclusion in the Omnibus State Government Finance bill.

Representative Hilstrom and Tom Deans, Legislative Council, MSBA, testified in support of HF 1160.

At 4:05 P.M. Chair Kahn recessed the meeting until the call of the Chair.

Chair Kahn reconvened the Committee at 4:38 P.M.

HF 1110 (Hilty) First Engrossment - Election definitions and procedures modified, complaint and resolution process established, penalties imposed, and money appropriated.

Representative Hilty moved that HF 1110 be heard and laid over for possible inclusion in the Omnibus State Government Finance bill.

Representative Hilty and Beth Fraser, Director of Governmental Affairs, Secretary of State's Office, testified in support of HF 1110.


HF 1223 (Hilty) First Engrossment - Elections; postsecondary institutions required to submit student residential housing lists, eligible proof of residence forms of identification expanded, and employee-list submission by residential facility operators eliminated.

Representative Hilty moved that HF 1223 be heard and laid over for possible inclusion in the Omnibus State Government Finance bill.

Representative Hilty and C. Scott Cooper, Lobbyist, Minnesota Voting Rights Coalition, testified in support of HF 1110.

HF 1618 (Kahn) First Engrossment - Domestic partners of state employees provided health insurance benefits if they are also made available to spouses.

Chair Kahn moved that HF 1618 heard and laid over for possible inclusion in the Omnibus State Government Finance bill.

Chair Kahn and C. Scott Cooper, Lobbyist, OutFront Minnesota, testified in support of HF 1618.

Jared Jordal, Department of Employee Relations, testified in opposition to HF 1618.

Representative Hilty moved that the minutes of March 22, 2007 be adopted. THE MOTION PREVAILED.
