Representative Benson, Vice-Chair of the Finance Committee, called the meeting to order at
10:55 P.M. on Tuesday, May 4, 2010, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Rep. Simon moved approval of the minutes of Monday, May 3, 2010. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Rep. Wagenius moved adoption the Environment and Natural Resources Finance Division Report for HF3124, Second Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Wagenius moved that HF3124, Second Committee Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Dill presented HF3124, Second Committee Engrossment (Dill) Aquaculture provisions modified, provisions for taking, possessing, and transporting wild animals modified, fish and wildlife management plans requirements modified, and game and fish license provisions modified.

Rep. Wagenius moved to amend HF3124, Second Committee Engrossment. (See attached amendment H3124A14). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Howes moved to amend HF3124, Second Committee Engrossment, as amended (See attached amendment H3124A15).

Bob Meier, Assistant Commissioner, Minnesota Department of Natural Resources, responded to questions regarding the proposed Amendment H3124A15.

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Wagenius renewed the motion that HF3124, Second Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Wagenius moved adoption of the Environment and Natural Resources Finance Division Report for HF3051, Second Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.
Rep. Wagenius moved that HF3051, Second Committee Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Dill presented HF3051, Second Committee Engrossment (Dill) Acquired stream easement modified; state forest boundaries provided; property exemption provided; state forest provisions modified; exchange of lands permitted within the BWCA; public access acquisition moratorium established; Lake Vermilion State Park acquisition provided, state parks and forests added to and deleted from; and public and private sales, conveyances, and exchanges authorized.

Rep. Wagenius moved to amend HF3051, Second Committee Engrossment. (See attached amendment H3051A10). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Kiffmeyer moved to amend HF3051, Second Committee Engrossment, as amended. (See attached amendment H3051A9).

Rep. Kiffmeyer moved to incorporate an oral amendment to Amendment H3051A9, as follows:

Page 1, line 1, delete "first" and insert "second"
Page 1, line 2, delete "Page 3, after line 3" and insert "Page 2, after line 32"

Kathy Lewis, Assistant Director, Lands and Minerals, Minnesota Department of Natural Resources, responded to questions regarding the proposed Amendment H3051A9, as amended.

Rep. Kiffmeyer requested a division on the motion. There were 6 Ayes and 10 Nays. THE MOTION FAILED. THE AMENDMENT WAS NOT ADOPTED.

Rep. Wagenius renewed the motion that HF3051, Second Committee Engrossment, as amended be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Vice-Chair Benson moved that HF3786 be recommended to pass and placed on the General Register.

Vice-Chair Benson moved to amend HF3786. (See attached amendment H3786A2).

Vice-Chair Benson moved to incorporate and oral amendment to Amendment H3786A2, as follows:

Delete all the incorrect spelling of "judgements" and replace with the correct spelling to read "judgments".

THE MOTION PREVAILED. THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Rep. Kulick Jackson presented HF3786, as amended (Kulick Jackson) Private transfer fees prohibited.

Christine Berger, Vice-President of Government Relations, Minnesota Realtors, responded to questions regarding HF3786, as amended.

Vice-Chair Benson renewed the motion that HF3786, as amended, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

The following Finance Committee Bills were referred by memo on May 3, 2010.

As of Monday, May 03, 2010, SF3003 (Bunn) solid waste disposal facility requirements modified is referred to the Environment and Natural Resources Finance Division.

As of Monday, May 03, 2010, SF2716 (Slocum) Charter school provisions modified, commission created, and charter schools permitted to borrow money is referred to the K-12 Education Finance Division:

As of Monday, May 03, 2010, the following bills are referred to the Transportation Finance and Policy Division:
SF2429 (Newton) Transit fee exemption provisions clarified for veterans with service-connected disabilities.
SF3105 (Holberg) Requirements established governing capital requests and legislative reporting for projects to establish fixed guideway transit and rail lines.

As of Monday, May 3, 2010, HF3786 (Kulick Jackson) Private transfer fees prohibited is recalled from the Energy Policy and Finance Division.

The meeting was adjourned at 11:46 P.M.
