Representative Benson, Vice-Chair of the Finance Committee, called the meeting to order at
8:02 A.M. on Thursday, April 30, 2009, in Room 10 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Vice-Chair Benson moved adoption of the Public Safety Finance Division Report for HF0702, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Vice-Chair Benson moved that HF0702, First Committee Engrossment, be recommended to pass and be placed on the General Register.

Rep. Hilstrom presented HF0702, First Committee Engrossment (Hilstrom) Summary data collection and reporting required relating to decisions that affect a child's status within the juvenile justice system.

Vice-Chair Benson renewed the motion that HF0702, First Committee Engrossment, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Vice Chair Benson moved adoption of the Transportation Finance Division Report for HF0008, Second Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Simon moved that HF0008, Second Engrossment, be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Simon presented HF0008, Second Engrossment (Simon) False Claims Act.

Rep. Simon moved to amend HF0008, Second Engrossment. (See attached amendment H0008A8). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Simon renewed the motion that HF0008, Second Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Vice-Chair Benson moved adoption of the Transportation Finance Division Report for HF1816, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.


Vice-Chair Benson moved that SF1876, Second Engrossment, be recommended to pass and be placed on the General Register.

Vice-Chair Benson moved to delete the language from SF1876, Second Engrossment, and insert the language from HF1616, First Committee Engrossment. THE MOTION PREVAILED.

Rep. Morrow presented SF1876, Second Engrossment, as amended/HF1816, First Committee Engrossment (Morrow) Motor carriers, highways, and Department of Transportation provisions modified and updated, clarifying and technical changes provided.

Gene Halverson, Transportation Program Supervisor, and Erica Erhardt, Staff Attorney,
Minnesota Department of Transportation (MnDOT), responded to questions regarding SF1876, Second Engrossment, as amended.

Vice-Chair Benson renewed the motion that SF1876, Second Engrossment, as amended, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Vice-Chair Benson moved that HF1213, First Engrossment, be recommended to pass and be placed on the General Register.

Rep. Hortman presented HF1213, First Engrossment (Hortman) Prostitution penalty enhancement provision for repeat offenders clarified, and prostitution in a public place crime broadened.

Melissa Reed, Lobbyist, City of Minneapolis, responded to questions regarding HF1213, First Engrossment.

Vice-Chair Benson renewed the motion that HF1213, First Engrossment, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Rep. Paymar moved adoption of the Public Safety Finance Division Report for HF1270, First Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Paymar moved that HF1270, First Engrossment, be recommended to pass and be placed on the General Register.

Rep. Paymar presented HF1270, First Engrossment (Paymar) Short-term offender pilot project development required, county of community corrections departments authorized to develop pilot-project for short-term offender commitments, and reports provided.

Rep. Paymar renewed the motion that HF1270, First Engrossment, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Rep. Paymar moved HF1505, First Committee Engrossment, be recommended to pass and be placed on the General Register.

Rep. Paymar presented HF1505, First Committee Engrossment (Paymar) First and second-degree sex trafficking provided, criminal penalties increased for certain sex trafficking offenses, and sex trafficking added to the definition of crime of violence.

Mary C. Ellison, Staff Attorney, The Advocates for Human Rights and Statewide Human Trafficking Task Force, responded to questions regarding HF1505, First Committee Engrossment.

Rep. Champion moved to amend HF1505, First Committee Engrossment. (See attached amendment H1505A10). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.


Rep. Paymar renewed the motion that HF1505, First Committee Engrossment, as amended, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

Rep. Thissen moved that HF0804, First Engrossment, be recommended to pass and placed on the General Register.

Rep. Thissen presented HF0804, First Engrossment (Thissen) Guardian and conservator governing provisions modified.

Rep. Thissen moved to amend HF0804, First Engrossment.
