Representative Juhnke, Chair, called the meeting to order at 10:31 AM, April 21, 2009 in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Torkelson moved that the minutes of April 7, 2009 be adopted. THE MOTION PREVAILED AND THE MINUTES WERE APPROVED.
Rep. Juhnke moved that HF 2301 (Juhnke) Clear water activities relating to agriculture funding provided, and money appropriated; be recommended to pass and be returned to the Committee on Finance with a recommended re-referral to the Committee on Cultural and Outdoor Resources Finance.
Joe Martin and Dan Stoddard (Minnesota Department of Agriculture) provided testimony on HF 2301.

Rep. Eken moved the H2301A3 amendment (attached).

Rep. Eken moved to incorporate a friendly amendment as follows:
Page 1, line 8, after "grants" insert "to operations with 300 or fewer animal units and "
"And revision of punctuation and grammar as necessary"
[And amend the title accordingly]
[The amendment was incorporated]

John Jaschke (Board of Water and Soil Resources) provided testimony on the amendment.

Rep. Eken renewed the H2301A3 amendment (attached). THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Eken moved the H2301A4 amendment (attached).

Joe Martin (Department of Agriculture) and John Jaschke (Board of Water and Soil Resources) provided testimony on the amendment.

Rep. Eken moved to incorporate a friendly amendment as follows:
Page 1, delete lines 2 to 5
Page 1, line 6, delete "after" and delete "19" and insert "14, after the period."
Page 1, line 7, after "5" insert "Of this amount," and delete "are for a transfer to the" and insert "may be used for"
Page 1, line 8, delete "Board of Water and Soil Resources"
Page 1, line 9, after "with" insert "the Board of Water and Soil Resources and"
"And revision of punctuation and grammar as necessary"
[And amend the title accordingly]
[The amendment was incorporated]

Rep. Eken renewed the H2301A4 amendment (attached). THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Faust moved the H2301A6 amendment (attached).

Rep. Faust moved to incorporate a friendly amendment as follows:
Page 1, line 15, delete "$20,000" insert "$100,000 "
"And revision of punctuation and grammar as necessary"
[And amend the title accordingly]
[The amendment was incorporated]

Joe Martin (Department of Agriculture) provided testimony on the amendment.

Rep. Faust renewed the H2301A6 amendment (attached). THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Doty moved the H2301A5 amendment (attached).

Joe Martin and Adam Berg (Department of Agriculture) provided testimony on the amendment.

Rep. Doty withdrew the H2301A5 amendment (attached).

Rep. Falk moves an oral amendment as follows:
Page 1, line 14, after the period insert "No more than 15 percent of these appropriations may be used for administration and staff."
"And revision of punctuation and grammar as necessary"
[And amend the title accordingly]

Joe Martin and Dan Stoddard (Minnesota Department of Agriculture) provided testimony on the oral amendment.

Rep. Falk renewed his oral amendment. THE MOTION FAILED AND THE AMENDMENT WAS NOT ADOPTED.

Thom Peterson (Minnesota Farmers Union) Chris Radatz (Minnesota Farm Bureau) and Tim Gieseke (Livestock Environmental Quality Assurance Program) provided testimony on the bill.

Rep. Juhnke renewed the motion that HF 2301 (Juhnke) be passed and be returned to the Committee on Finance with a recommended re-referral to the Committee on Cultural and Outdoor Resources Finance. THE MOTION PREVAILED AND THE BILL WAS PASSED.
The meeting was adjourned at 12:41 PM.
