MINUTES


Representative Kahn, Chair of the Division, called the meeting to order at 1:10 P.M. on March 18, 2009 in Room 300 South of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.


HF 796 (Morrow) Minnesota First bond sale authorized.

Representative Bigham moved that HF 796 be recommended to pass and re-referred to the Finance Committee.

Representative Morrow testified in support of HF 796.

Representative Bigham renewed her motion that HF 796 be recommended to pass and re-referred to the Finance Committee. THE MOTION PREVAILED.

Chair Kahn discussed the Committee’s priority bonding recommendations to the Capital Investment Finance Division:

-Capitol building restoration funding
-Bonding for a Tier III data center
-HF0796 (Morrow) Minnesota First bond sale authorized
-Department of Military Affairs asset preservation, $3,500,000 unfunded from 2008

Chair Kahn recommended that the State Government Finance Division priorities be passed on to the Capital Investment Finance Division without objections.

HF 1086 (Wagenius) Park and trails fund, outdoor heritage fund, clean water fund, arts and cultural heritage fund, and environment and natural resources trust fund oversight provided and criteria established.

Representative Winkler moved that HF 1086 be recommended to pass and re-referred to the Finance Committee.


Representative Wagenius testified in support of HF 1086.

Representative Winkler renewed his motion that HF 1086 be recommended to pass and re-referred to the Finance Committee. THE MOTION PREVAILED.

HF 111 (Winkler) Divestment required from certain investments relating to Iran.

Representative Winkler moved that HF 111 be recommended to pass and re-referred to the Finance Committee.

Representative Winkler then moved the A-3 amendment.

Howard Bicker, Director, State Board of Investment, testified that the Board has no official position on HF 111 but recommended some changes to the A-3 amendment.

Representative Winkler moved to amend the A-3 amendment as follows:


Page 1, line 8, after "Page 4," delete "line 12, delete everything after "quarterly" and insert "updated and submitted annually"

Page 1, line 12, after "must" insert "to the extent feasible"


THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Winkler testified in support of HF 111.

Representative Winkler renewed his motion that HF 111 be recommended to pass as amended and re-referred to the Finance Committee. THE MOTION PREVAILED.

HF 905 (Doty) Commissioner of military affairs authorized to accept uncompensated and voluntary services.

Representative Koenen moved that HF 905 be recommended to pass and re-referred to the Finance Committee.

Representative Doty and Don Kerr, Principal Planner, Department of Military Affairs testified in support of HF 905.

Representative Koenen renewed his motion that HF 905 be recommended to pass and re-referred to the Finance Committee. THE MOTION PREVAILED.

HF 8 (Simon) Minnesota False Claims Act established.

Representative Simon moved that HF 8 be recommended to pass and re-referred to the Finance Committee.

Representative Simon testified in support of HF 8.

Deborah Peterson, Assistant Attorney General, Attorney General’s office, testified in opposition to HF 8.

Representative Simon renewed his motion that HF 8 be recommended to pass and re-referred to the Finance Committee. THE MOTION PREVAILED.

Representative Bigham moved that the minutes of March 17, 2009 be adopted. THE MOTION PREVAILED.
