MINUTES



Representative John Lesch, Chair of the Crime Victims & Criminal Records Division, started the tenth meeting at 8:35 am on Friday, March 5, 2010 in the Basement of the State Office Building. A quorum was present and the meeting was called to order.

The Committee Legislative Assistant noted the roll.

Agenda/ Action:

Chair Lesch called for a motion to approve the minutes of February 26, 2010.

Rep. Hilstrom moved to approve the minutes of February 26, 2010.
THE MOTION PREVAILED AND THE MINUTES WERE ADOPTED.

HF3312 (Greiling): Criminal penalty provided for intentionally rendering a service animal unable to perform its duties, offenders convicted of harming service animals required to pay restitution, and civil remedies are not precluded by the criminal penalty for harming service animals.

Chair Lesch moved that HF3312 be recommended to pass and be re-referred to the Committee on Public Safety Policy & Oversight.

Rep. Greiling presented HF3312 and took questions from the committee.

Chair Lesch renewed his motion that HF3312 be recommended to pass and be re-referred to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF2960 (Paymar): Background check required for transfer of a firearm at a gun show and penalty provided.

Rep. Paymar moved that HF2960 be laid over for possible inclusion in the Crime Victims Division Report.

Rep. Paymar presented HF2960 and took questions from the committee.

Kurt Johnson, MN Auctioneers, testified on HF2960 and took questions from the committee.

Joseph Olson, Gun Owners Civil Rights Alliance, testified in opposition to HF2960 and took questions from the committee.

Rep. Paymar renewed his motion that HF2960 be laid over for possible inclusion in the Crime Victims Division Report.

Chair Lesch laid HF2960 over for possible inclusion in the Crime Victims/ Criminal Records Division Report.

HF3131 (Mullery): Interstate Compact for Juveniles adopted.

Chair Lesch moved that HF3131 be recommended to pass and be re-referred to the Committee on Public Safety Policy & Oversight.

Rep. Mulllery presented HF3131 and took questions from the committee.

Roseanne Bish, Dept. Corrections-Interstate Compact, testified on behalf of HF3131 and took questions from the committee.

Chair Lesch renewed his motion that HF3131 be recommended to pass and be re-referred to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF3381 (Mullery): Juvenile history data retention increased to one year for a child who was arrested but not referred to a diversion program and delinquency petition has not been filed.

Chair Lesch moved that HF3381 be recommended to pass and be re-referred to the Committee on Public Safety Policy & Oversight.

Rep. Mulllery presented HF3381 and took questions from the committee.

Katie Engler, MN Bureau of Criminal Apprehension, testified on behalf of HF3381 and took questions from the committee.

Chair Lesch renewed his motion that HF3381 be recommended to pass and be re-referred to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

Chair Lesch reminded committee members and staff to watch for public notice of additional meetings outside the regularly scheduled time.
