MINUTES

Representative Schomacker, Chair of the Human Service Finance and Policy Committee, called the meeting to order at 8:24 AM on April 16, 2026, in Room 123 of the State Capitol Building. A quorum was present.

The Committee Legislative Assistant noted the roll.

Representative Jacob moved the minutes of April 15, 2026, be approved. THE MOTION PREVAILED.


HF4338 (Schomacker) Parties who may be awarded fees and expenses in proceedings involving the state modified, requirements for assisted living facilities to provide residents with a means to request assistance modified, and assisted living facilities exempted from the provider tax.

Chair Schomacker moved that HF4338 be re-referred to the Committee on Ways and Means.

The committee heard the following amendments to H4338DE1, which was introduced on April 15, 2026.

Representative Curran moved to adopt the H4338A2 amendment to the H4338DE1. THE AMENDMENT WAS ADOPTED.

Representative Curran moved to adopt the H4338A3 amendment to the H4338DE1. Representative Curran withdrew the H4338A3 amendment to the H4338DE1.

Representative Curran moved to adopt the H4338A4 amendment to the H4338DE1.

Representative Curran moved to incorporate the following oral amendment to the H4338A4 amendment to the H4338DE1: On Page 1, line 6, after the colon insert “up to”. THE ORAL AMENDMENT WAS INCORPORATED.

Representative Curran moved to adopt the H4338A4 amendment, as amended, to the H4338DE1. THE AMENDMENT WAS ADOPTED.

Chair Noor moved to adopt the H4338A5 amendment to the H4338DE1. THE AMENDMENT WAS ADOPTED.

Chair Noor moved to adopt the H4338A6 amendment to the H4338DE1. THE AMENDMENT WAS ADOPTED.

Chair Noor moved to adopt the H4338A7 amendment to the H4338DE1. THE AMENDMENT WAS ADOPTED.

Representative Backer moved to adopt the H4338A8 amendment to the H4338DE1.

Representative Norris requested a roll call vote. The results were as follows:

Representative Hicks moved to adopt the H4338A11 amendment to the H4338DE1. THE AMENDMENT WAS ADOPTED.

Vice Chair Keeler moved to adopt the H4338A12 amendment to the H4338DE1.

Vice Chair Keeler moved the following oral amendment to the H4338A12 amendment to the H4338DE1: On Page 1, delete line 4 and insert “living or working outside of the seven-county metro area”. THE ORAL AMENDMENT WAS ADOPTED.

Vice Chair Keeler renewed the motion to adopt the H4338A12 amendment, as amended, to the H4338DE1. THE AMENDMENT WAS ADOPTED.

Chair Noor moved to adopt the H4338A13 amendment to the H4338DE1. THE AMENDMENT WAS ADOPTED.

Chair Noor moved to adopt the H4338A14 amendment to the H4338DE1. THE AMENDMENT WAS ADOPTED.

Chair Noor moved to adopt the H4338A10 amendment to the H4338DE1. THE AMENDMENT WAS ADOPTED.

Chair Schomacker moved to adopt the HF4338DE1, as amended. THE AMENDMENT WAS ADOPTED.

Chair Schomacker renewed the motion that HF4338, as amended, be re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.


The meeting was adjourned at 10:04 AM.
