Legal presumption for child support modifications would flip under bill OK’d in House

The House passed a bill Monday that would reverse a legal presumption to child support law.

Sponsored by Rep. Peggy Scott (R-Andover), HF3389 would reverse the presumption, from the current “not substantial,” to “substantial” in a child support modifications. The bill passed 123-0 and next goes to the Senate, where Sen. Mary Kiffmeyer (R-Big Lake) is the sponsor.

Under current law, the terms of a child support order may be modified after showing the order is unreasonable and unfair. The law explains rebuttal presumptions for “substantial” changes in circumstances. This bill would reverse that presumption.

Scott and Rep. Laurie Pryor (DFL-Minnetonka) highlighted that the bill came out of a legislative task force.
